I hope you can help me with a couple of questions.
First: Do you have a ‘SAMPLE OHIO FORM’ (with space for ‘Fill-In-The Blanks’) for an Ohio Land Contract Agreement?
Second: What authority does a ‘Vendee’ have in managing the property he/she is in the process of purchasing under the otherwise unspecified ‘General Terms’ of a Land Contract? For example, the ‘Vendee’ is purchasing a home that he occupies from his Aunt. The Aunt’s daughter (his cousin) has been residing in that house for several years, but is not named in any manner in the Land Contract that the cousin is stipulate as an ‘exception’ tenant that the ‘Vendee’ is required to house as part of the agreement. Issues have arisen that make the presence of the cousin in the house a growing matter of contention and he wants the cousin to leave, but the cousin so far has not been willing to do so. The cousin’s mother… the ‘Vendor’, has been unwilling to have her daughter leave as requested. So far, the ‘Vendee’ has made all agreed upon payments on time and is fulfilling all other stipulated terms. Does he have generally the same property management rights as he would have if purchasing the home from a bank?
Can he treat his cousin like a ‘trespasser’ and have her legally removed from the house? Note: She does not pay the ‘Vendee’ any monthly ‘rent’, nor is there any indication that she pays any ‘rent’ to her mother. There are a great many areas that “I” as a Homeowner making payments to a mortgage holder to pay for my home still retains apart from consulting the mortgage holder for permission to act.
Hope you can provide a link to the sample form, and can clarify the level of ‘assumed authority’ the ‘Vendee’ has under normal conditions.
