Can anyone tell me if there are new laws that will be changing the game here for us?  Like forced pooling or laws that make the oil and gas companies not hold a lease for 100 years with just delay rentals etc...what changes are coming that will turn the tables a little bit?

Here in PA I think an excellent law would be to have mineral rights AUTOMATICALLY revert back to the surface owner after a set amount of inactive time. OR how about the mineral rights owner pay some of the property taxes. I pay property taxes on 74.7 acres but found out recently that OGM's are owned under almost 24 acres of it by a mining company since 1927! These are leased , thankfully , with the same oil co. as me so for that I am thankful at least. Bummer is I sat down tonight and wrote over $3000 worth of checks for school , boro , and county taxes! (yes I'm a little late) To add insult to injury those 24 acres WHICH I PAID FOR AND CONTINUE TO PAY PROPERTY TAX ON took $72,000 out of my pocket (signing bonus lost) and placed it in the hands of a company owned by a foreign concern (Mexican). Not a good feeling. I am greatful for the 51.6 acres I own completely though.

In Mexico you are not alowed to own land just a 99 year lease if not mexican

haha funny but I do get what he is saying.. for sure...we have land that has one parcel with another family owning 1/2 of the rights and I have looked for them for over a year now... I searched their family out on Ancestory.com and searched birth records and obituaries etc etc... and it looks like the family just disappeared.  They moved out of PA years ago and it looks like the line may have just ended and no one is alive..so there sets something worth money for some one that's going to waste... well at least for the public haha

Lynn - The Pennsylvania Dormant Oil and Gas Act provides for development of oil and gas rights  in situations like yours..... you should consult an attorney on how to proceed.

Lynn, follow the money, find out if that phantom family had escrowed royalties thru the century.  This would show production, if not there should be reversion.

If you own half interest, you pay half the property taxes.   Look to see who pays the other half.   If no one is paying the other half of the taxes, wait for a tax sale.

In PA the surface owner pays the property taxes. Otherwise alot of people are owed alot of money since 1927 on this and many more parcels. At last count Shell was over 3000 acres of Cemex (mining co.) mineral rights in this area. They have the leasing rights to these OGM's. As deed searches are completed they keep discovering more. Cemex still physically holds alot of surface acres as well that include OGM's. My point is that it stinks that we pay the taxes on land that someone else will profit from! AND it costs them not one dime to hold indefinitely! Remember this is PENNSYLVANIA we are talking about. A new law counteracting this would be awesome for thousands of Pennsylvanians.

Glenn; Be careful of what you ask for.  There are no taxes on mineral rights.  If you insist on getting one passed then landowners will have to pay additional taxes on all rights, mineral oil and gas, even they are not leased. This means you would have been paying additional taxes all those years you weren't leased.

And the assessed value would be on the potential value of those rights which you may never get. What if a well is never drilled on your property? Doesn't seem right to be taxed on something that may never be realized.

Further, if you rent or lease a house you don't pay the taxes on it, the landlord does. Of course, he/she will figure the rent with the tax cost included but it the taxes go up while a renter is under contract at a set price,  the landlord has to pay them.

I would much rather see a law passed that reverts OGM's to the surface owner after a set time of inactivity for sure. In my case it's been 84 years for crying out loud.

Yeah, don't wanna pay taxes on all the coal and limestone on my property since I will never have it mined!

I own just mineral rights on multiple parcels in Clearfield County and I pay property taxes on all of them so people who own the mineral rights are paying taxes on these.
