Famous Buell well (Buell 8H) about to be shut down!!! Chesapeake doesn't own horizontal drilling rights!

Looks like Chesapeake's "best shale well ever" is actually owned by Kenneth Buell.

Hi. I did not look at every page of this permit but in the defense of ODNR there is a section that shows exactly who the surface owner is and a place to list every mineral owner in that unit. In this unit of course only one coal co. is named so it's easy to see (page 26). I see they also list the section and other info but you are right, not page and volume the lease is recorded. I honestly never thought it was ODNR's job to look at every lease, they just can't. If they were required to do so I guess for the unemployment rate it would be a plus since they would need to up their man power quite a bit to say the least.
I believe ODNR is doing all it can to keep this straight by listing all parties on the official paper work. At some point if you feel you are being unjustly drilled upon or under you can access these permits, drawing and reports and do what you feel is nessasarly to correct the problem.

Obviously, my point is not to suggest ODNR is lax, but to prove it's not their job to ensure property rights are being respected (as somebody suggested it was), let alone offer redress when a credible allegation of property violation is made. That job is left to judges and the courts, which is why it's simply amazing to read a few posters whine about the Buell lawsuit and somehow claim to be pro-property rights. As if they would stand pat and do NOTHING when the law said that their property rights were being violated. Nobody really believes that.

Yup :0). I actually got further but if I remember right it's routes on bringing in water and other stuff and I decided I really didn't care about that. :0)
I do think this document should open some eyes on what the ODNR does not do and each landowner should make sure their rights are protected if a unit is close to them. I personally never knew this type of detailed document was out there for public viewing. I would love to get my eyes on the one for the unit near me. Very interesting (and boring lol) and thanks for posting it.

I would think that perhaps it might be a good idea to point out the pitfalls of this process and in creative criticism suggest changes to the ODNR with copies going to the governors office as well as legislators.
