SB 259 was passed and is awaiting the governors signature.
In short is takes away the property rights of land owners in favor of expediency of forming drilling units for drilling companies.
Landowners will no longer be allowed to re-negotiate their leases , this is a violation of the protections of property rights guaranteed under the U.S. Constitution.
Please take the time to e-mail the governor and ask that he veto SB 259.

Correcting my post....I meant to use the word "unitization" and instead used the the word "assignment". This is probably because I have posted in the past about whether an O&G company can "assign" a lease to another entity when the lease is silent on that issue. My answer to that question is that such assignments should be valid without the landowners consent, unless the lease in question prohibits such assignment without such consent. I again realize that others may disagree with me.
That is assuredly your right to disagree and you have been courteous in doing so. As I said before many of my posts to other threads have been quite critical of O&G companies. Sometimes spirited but polite discussions reveal that issues that are clearly right from one point of view seem clearly wrong from another. Oftentimes the truth is somewhat in between polar positions. I hope you realize that the horizontal legs can be curved such that small parcels that stand in the way may not be drilled ever, and may never be included in a drilling unit, let alone have a well located on them. I am trying to make the point that for small landowners, their bargaining position may be little if any enhanced even if the Governor of Pennsylvania vetoes the bill in question.

You are a remarkable know-it-all. You know more than NARO for goodness sake! You are the consummate expert. If you're the PA landowner you claim to be, you are a fool. But if you are in reality a gas company shill, as I believe, you are an astute individual and a smart operator.
Think it will matter. All the Politicians are in the Gas Company's pocket. They don't care about the landowners just profits!
Gary: Do you really believe our legislators are accepting bundles of cash delivered to their doors in brownpaper bags in the middle of the night? I believe that Pennsylvania legislators see the O&G industry as the engine of economic revival for Pennsylvania. Assuredly some regulation is necessary but I believe Pennsylvania legislators have tried to make doing business in Pennsylvania a good place to do business with significantly less burdensome regulation and taxes when compared with other states such as Ohio. This may be justified by the fact that western Pa geology while good is markedly less good than eastern Ohio. I am sure you would not wish to live in New York where there is a moratorium on fracking, a fact that prevents New York farmers from getting any lease offers whatsoever. I believe our legislators are trying to do the right thing. I do not believe they are being bribed by O&G companies. I do not deny that the bill in question should perhaps be vetoed and be reworked. Nevertheless be careful what you wish for. It is quite possible to kill the golden goose! I think the antifrackers and the tree huggers are laughing gleefully when they find they have allies like you Gary and like Joseph and like Frank Walker who are all unwittingly doing their bidding. Since you Joseph are from Ohio, you might read the threads about Dux Petroleum if you are concerned about real skullduggery in your own state!
PA politicians can try to kiss up to the USSR if they want to. Let PA politicians use the tax payers land and have the tax payers say so to deal with includine elections. But don't kiss up using private property that they do not own!
