Can you recommend an attorney for me? I have property in Marshall County, WV but I don't live there. I have mineral and surface rights. I have a new ROW contract that I need reviewed. I also have a drill pad with one well that was shut down 1 year ago. I am new to all of this. I don't like the fact that Williams Co wants a perpetual lease on this next line. Help please.

I recommend Kyle Nuttall on this site, who is an attorney living in Buckhannon WV. Just do a search for his name.

Below is a response I gave a while back to someone who asked the same question in WV. A pipeline ROW contract must be very specific or you could end up handing over your future ROWs to the company that fishes you in with a bad contract. Use a lawyer or know the pitfalls and write a detailed contract. I called David and he advised me who to contact in Ohio since he does not work outside of WV.
A lawyer in WV, David B. McMahon, wrote the following that you can find on the internet:
What Land/Surface Owners Should Know When a Landman Shows Up And Wants an easment/Right of Way To Put a Pipeline Across Your Land. Prepared by David B. McMahon • Attorney at Law Concentrating in Oil and Gas for Smaller Mineral Owners 1624 Kenwood Road, Charleston, WV 25314 Voice/VoiceMail 304-415-4288 • Fax 810-958-6143 E-mail: wvdavid@wvdavid.net

Call David and read his guidance on line. Ron
Craig Sweeney at Yoss Law in Woodsfield, Ohio - not sure if he is licensed in WV but just across the river.
Thank you! I have used everyone's information and it has been very helpful. Now just to narrow it down! Thanks again!
Hey, FWIW - I signed yesterday with Paloma and the landman told me I picked the BEST attorney. He said Craig Sweeney actually knows what he is doing in this business, unlike most of the attorneys who decide to "jump in" and try.

AboutWhat makes this site so great? Well, I think it's the fact that, quite frankly, we all have a lot at stake in this thing they call shale. But beyond that, this site is made up of individuals who have worked hard for that little yard we call home. Or, that farm on which blood, sweat and tears have fallen. [ Read More ] |
