I talked to the Monroe County Court today and found out by pure accident that Beck Energy appealed their case just today. For those that don't know, the case was moved to Washington County Court by the Ohio Supreme Court. The decision came down that Beck Energy leases were "not in the Public Interest" in the state of Ohio. In other words Beck lost and the landowners won. Now the appeal process has begun. My lease with Beck hangs in the balance as do 270+ Monroe County landowners just like me!

He is a company landman with company lawyers behind him. Not saying it's a bad thing in any way. Acting like you are not to get leases is something alltogether different.
I went to two meetings and asked questions. It would have been a whole lot easier to accept if they just said. We are here in behalf of....we are their representative.....we gat paid a percentage of the deal they offer to you....this is the deal they are offering....you might get picked and you might not. They may allow some changes....may not others...It's your choice.
Because this is actually what happened.
Posting this info in this position so all can follow another case. In the U. S. District Court of Southern Ohio Eastern Division: Wellington Resources Group vs. Beck Energy.
Wellington states Beck received $84,961,346 dollars from XTO for the transaction in Monroe County. Guess what Beck forgot to pay the 5% fee owed to Wellington for brokering the deal.

Joe, since the court found that since Binder did not hold a real estate licence & could not receive a fee or commission on referring leased mineral law wouldn't that also have a major impact on the landman with a landgroup in several counties that also has no real estate license? is that why he has disappeared since his title deal went bust?

I don't know what to do with this information. I just found out that Beck recorded a lease on my property with a 2006 date that wasn't actually signed until 2007 or 2008. And the information that was filed was for a Gas/Oil lease, but we actually signed a lease for an easement. I don't know what to do or who to contact. I haven't lived in Ohio since 2005, but even my address is stated as being down there. Plus, I was remarried and just signed an actually lease a few months ago, and my new husband had to sign the paperwork also, because Ohio is a Dower state. Should I contact Beck myself, or should I just contact an attorney? If I need an attorney, who should I call?
Contact Dale Arnold at the Ohio Farm Bureau. He is an expert in the leasing process, gives seminars on the subject, and is an all-around good guy on your side. Call him up if you like. He has a list of oil/gas attorneys that he recommends, and would be glad to send it to you. Make sure the attorney you get ONLY practices oil and gas law....not divorces, estates, etc...
