Feel like I have been left in the dark! Does any one  know anything about Aubrey and any drilling? I NEVER hear about any activity concerning his company(AEP). I first signed on with Shell, then Shell sold out to AEP and that has been that. Does anyone else, that has their lease through AEP, know ANYTHING about what is going on and when there might be some drilling starting?

The other companies are so much ahead of AEP! You are always hearing about this well and that well or company but never anything about Aubrey's AEP company doing anything. Am I the only one hooked up with AEP? I never see anyone else asking questions about AEP). ---------Fell like the lone ranger!

On the "Affidavit of Facts" dated June 24, 2014, that K&R has filed, with our mineral right location listed) names Robert Walls as president.

But on some other site I have been looking at, it states K&R Conservation LLC c/o Richard Bevington.

???--------- I think it could be a group of people. What do you think?

Contacted today, the  attorney you had and  recommended to us but he said he couldn't assist us and recommended Keith Plummer. Do you know him?

My father sold his property that he owned and now is part of K & R Conservation BUT did not sell his mineral rights. My brother and I inherited the mineral rights when my father passed in 1991.  K & R own the land but I and my brothers own and now leased(to Shell in 2011 then AEU bought from Shell) the mineral rights. What's your thoughts on this?

American Energy Utica has submitted to ODNR for 12 wells in Belmont County since 6/24/14. Looks like he is ramping up at least in Belmont County.

Now I have a question about the wells on the property of K& R Conservation. I did NOT own the property, which is now, K & R Conservation,(my father sold the land) My Dad's former land IS part of K & R Conservation. My Dad owned the mineral rights. My Dad sold his property/land but did not sell the mineral rights. I, along with 2 brothers, inherited these mineral rights from my father, after his passing in 1991.

What I am not understanding is that K & R owns the land but my brothers and I own the mineral rights on their land. We are the owners of the mineral rights we first leased to Shell(2011) and  then AEU bought from Shell, about a year ago.

Do you think we have been ripped off by K&R since we own/ leased the mineral rights on their property and have since leased the mineral rights on the property that K & R owns? We haven't ever received a penny of royalties from any of the old wells you referred to.We own the mineral rights, NOT-- K & R Conservation LLC!

They legally cannot cash in on any oil/gas royalties, can they,since we own the mineral rights? If these wells are on the part of Conservation, that my father once owned, shouldn't I and my brothers be the receiver of any royalties? Do I need a lawyer or am I misunderstanding you, Phillip?

Here are well cards from three of the many old wells on your mineral holding.  It looks like your father leased the land back in the 1980s.  They are still producing.  I wonder who is getting the royalties?  If I owned as much mineral acres as you and your brothers I would defiantly hire a GOOD oil and gas law firm.

OMG! Thank you so much ,Phillip! I can't believe what I am reading! The well cards show that for 28 years, someone has pocketed our mineral rights $$ and it wasn't my family!

Don't know where to start. I live out of state and know of no oil/gas law firm. Do you have any suggestions? By the look of the cards, a few people have cashed in on our mineral rights! Do you think it will be possible to recoup that $? The first link is for section 15. My Dad's is section 21. How many wells do you think is on the land my Dad owned/sold(80acres) but  still owned the mineral rights to?  Or is it just the papers you sent me, showing 2 wells, both gas and oil?

In your reply you state that my Dad must have leased the land back in the '80's. My Dad sold his land in 1967 or around that. Am curious where you got that info and how do I find how to see if there are more records for anything else pertaining to my Dad's mineral rights for gas and oil and perhaps more wells producing?

My Dad was still alive when this drilling started in '85, if I read the link correctly, and I wish more than anything he could have reaped the benefits but instead someone STOLE his $$. Now it seems that my brother and I should be reimbursed for all those years(28!) and maybe someone should end up in a place he would never want to be in!

Is there anything else I should know before I start hunting for attorneys? I really have no background in this situation whatsoever so we do need help.

Don't panic, your land looks like it is part of a 590 acre parcel.  You may not have a gas well on your 80 acres. learn how to use the ODNR Oil and Gas well viewer to find out if you actually have a well on your land.

I assume that Shell checked out your ownership before they paid you your signing bonus.

I understand that.But I am very concerned about who received the royalties for the last 30 years from our family owned mineral rights. You have to understand my "panic" and what it will take to get to the root of all of this mess this. Not what I really ever wanted to happen. Alot of mental stress!Someone or ones have pulled a fast one on us for 30 years and I will now have to do a lot of "leg" work to straighten this out! Have never been in a situation like this before.

Have you heard of the attorney, Dave Bennett? He has been mentioned on the Marcellus site in the past. I guess I will start there. I probably won't take the first attorney I talk to. I am sure he would love our "case." I want to find someone who will take a great interest in the situation.

Yes, Shell investigated our mineral rights we owned for the 80 acres on the K & R Conservation. For the large bonus money, they gave each of us, I am sure they did a thorough job. Plus we brought our quit claim deed, showing my Dad being the owner of the mineral rights (and the rights being signed over to his 3 sons), the day of the signing in Cambridge, Ohio, in 2011, with the Shell attorney. And the County Recorder,Colleen Wheatley, recorded it, as well. Also, when my Mom received a phone call jn  1967, after selling the 80 acres of land, asking if they wanted to sell the mineral rights, she emphatically said ------No!------, in no uncertain terms!!

Did you check the ODNR gas well viewer to see if you have a gas well on your 80 acres?  Don't panic until you know for sure that there is a well on your mineral holding.  The well cards that I posted are on the 590 acre parcel.  They may not be on your acreage.

David Bennett reviewed my ROW with Mark West.  I thought he did a good job.  KWGD http://w***********/oil-gas-and-mineral-law handled my lease with Gulfport.  They are more experienced than David Bennett but they will charge a lot more.

Did you happen to read Dexter Green's reply a few minutes ago? He feels that the $ we might be reimbursed might not cover the legal fees. How do you feel about that statement? Agree or disagree? Will keep your attorney in mind, though. Do they offer a complimentary first consultation to see if it is worth working on?
