Just got information from our county auditor that property taxes on all coal and minerals is increasing by large percentages. My question is: If you own coal, and another landowner owns the oil and gas, does the drilling company have to lease with the coal owner as well to go through it?

Carolyn I 'd like to know the same thing too. We have surface with minerals and another with the coal here in PA. From what I have been told the person that owns the coal here in PA is the only one who pays taxes on the minerals (DON'T THINK THAT IS RIGHT). So if surface owner leases what happens to the coal and the methane gas? Will be interesting to see what gets posted here. Good luck with those taxes ours went up too. But if the landowner is the one that owns the coal, the driller can go right through the coal. The landowner, when they signed a O/G Lease, gave approval to do this, either implicitly or explicitly. There are variations from state to state where Coal companies can exercise their ownership (and potentially block O/G development), however, business being business, O/G and coal will work together in establishing what they both need for subsurface development.
Remember, generally, subsurface ownership rights trump surface rights. This is an important establishment in legal precedent regarding these rights.
We have been told to forget about our coal under other surface owner. That He will never permit the coal to be removed. This is in PA a very old deed that is fee simple but the township its in is LEFT over HIPPIES that feel they have the right to dictate what one can or can not do on or with their own personal properties. It has been something to watch the old hippies come out to protest coal mining clean ups paid for by the federal government .I think they are smoking to much of this new weed its to strong for their weak minds....Sorry for ranting on
