I was offered $5,000 per acre plus 20% on 10/11/09 by a Chesapeke landsman. The lease is very different from the one agreed to by the Wyoming group. The landsman stated that leasing will stop soon for some parts of Sullivan County and any new offers to others will be in the $2,000 range. Our lawyer (Greevy Associates in Williamsport)said he had heard the same information.
Some differences: (PLEASE NOTE THESE ARE OUR INTERPRETATIONS OF THE LEASE AGREEMENT) Liability for the company is limited to negligence. The bonus money is paid within 120 days, there is no money at signing. There isn't a limitation on the pool size (acerage). There is no guarantee that the water will be returned to its origional state and no mention is made about paying taxes if the property was included in the "Clean and Green" catagory.
I sent some changes in the agreement back to the landsman last night but he told me he did't think they would be agreed to.
It sounds like quick action has to be taken before the leasing stops.

120 days is a long time to wait - certainly gives them a long time to back out - i assume it's a bank draft? They are paying these bank drafts within 15 business days in other locales. I would be interested in hearing his reasoning for the 120 day wait.

Was this a Chesapeake broker or was he an employee for Chesapeake?

What alterations did you make to it?
Lester Greevy represented us in our landowner's group last year. I wonder if he could recommend a group for you to join in order to get better terms. I suspect the reasons for the difference in lease terms is that you are not part of a group and that Sullivan County is still "unproven".

We spoke to a landman who said 120 days is used for title searches of those who have signed leases, to ensure ownership of the gas rights.
it is a state law that the exploration company is responsible for the condition of the water and is presumed to have caused the issue if the well is within 1000 ft. of the drilling site. however, it is not their responsible to test prior to or come back to do a test. so you should be ready to do your testing with a certified 3rd party such as Seawald Labs iin williamsport.
by the way, the Sullivan county Energy task force meets the 4th monday of each month (except this month it is on saturday 2/27 )at the Courthouse. JOHN SILLA, CHAIRMAN, SCETF.
Who or what is the Sullivan County Energy Task Force? I have lived the the county all my life and have never heard of this group. Is this a private group?
Jeff, this TF was created about a year ago by the County commissioners and in December 2009 the 3 turned it over to the citizens to run within various committees.
The Sully has written many articles on the programs we conduct.
I invite you to look at the county government website www.sullivancounty-pa.us and on the bottom left hand side there is a space to click ENERGY TASK FORCE. We are concerned citizens, not any government agency, just one of a dozen Task Forces within Pa. counties which contain the Marcellus Shale.
