Just received a call from Cougar that they will being doing siesmic testing on my land Sunday afternoon.  He said that it is the 3D testing and they will be drilling holes and dropping explosives.

 

Has anyone else had this done on their place?  And if so, what follows next?

They shouldn't do it on Sunday for Petes sake! Common sense would say wow lets make some bangs on the day of worship and rest. Bet that goes over with a bang with church goers. They should inform all in the area as to their activities and do it during normal work hours. 

The Cougar rep said that the field people do not work on Saturday and that all affected landowners were being notified.

Hi Chip...Im close to speidel road, Hanoverton, they have the metal boxes lined up and down the roadway by the flags for the last week, Im thinking we might have some fireworks around here this weekend too! The helicopter has been dropping big orange bags of ??? across the fields in front of me but I havent had a call yet  (-:  I did see in the morning journal that the testing set off a security alarm in Lisbon, makes ya wonder how shakey its gonna get!  

Judge Reinbold gave an injunction to Cougar several weeks ago to allow them on properties, in Columbiana Co. Common Pleas court.  Geiger Teeple out of Alliance is the firm who pursues those cases. If you have a Chesapeake lease, know that Cougar is probably an agent for Chesapeake. Ken Bandy represented one of the landowners.

Well, I went down to the farm over the weekend.  Cougar was in the area doing their thing, but did not make it back to do any drilling.

 

I drove through the woods.  I found a dozen or so pink and white ribbons with pink marks on the ground and about 4 orange markers with orange painted on the ground.

 

I also spoke with a township trustee who said that he has a map for "proposed" wells in the township that was provided by CHPK.  He told me that if all goes according to plan, we will be in a production unit by the end of next year.... we shall see.

This process seems to take a long time. I also thought when they said they wanted to start seismic testing the week after the super bowl I thought that's when it would be done. It seems they are just telling you they will be around when they call you. That week blue and white flags were staked where permission was given. A month or more later came the pink and white flags and one orange stake. Easter weekend the company pathfinder who does the GPS for this was out and about. A couple of weeks ago a company called excel drillers were parked in the fields but i didnt notice anything being done. These guys are stealth I swear. It's now mid June and I have new just pink flags with trails cut into the woods about 20 feet+ from the pink and white flags with those ribbons tied as far as I can see or care to walk. So after almost 4 months we still aren't done.

So far everything you have said is right on the money, except that the timing seems to be moving faster.  I had blue flags two weeks ago, now there are pink, orange and white one all over my woods.

 

They have not cut any paths in the woods.. they seem to be following the one previously established.

They followed our established paths and neighbors months ago with the pink and white. These solid pinks cut into the woods seem different.
I always wish to say hi to who's working outside and try to find out info since no one will send me my monday morning memo for the weeks activities :0) but we honestly never catch them working. I have a very barky dog and they get past him too. We have all joked that these guys must be working the graveyard shift but we know they aren't :0). So far I only met the blue and white flag guy since he knocked on my door before he started and two of the pathfinder workers Easter weekend.
I wonder if CHK gave all the trustees in each township proposed well sites. Hmmm. I would love to see those maps.
Did you get water testing papers? That seems to be a signal your in a coming soon unit. We did and got the results Friday. I'll never drink my water again nor will I light a match near the well :0).

  I heard a secret the other day Red White and Blue Flags will be all over the state on the 4th of July in protest of Obama energy policies.

Cougar Land works for TGS.  TGS is an independent company that collects data and then sells the data to oil/gas companies.  TGS was ordered by Judge Reinbold on May 21, 2012 to produce evidence of it's  relationship with CHK, but has not produced this evidence yet.  Despite the lack of evidence, Judge Reinbold gave TGS a TEMPORARY injuction to perform seismic on two properties, with the stipulation that the data is to be held and not used until the court makes the final determination on who should have access to this data.

There are many landowners in the county that have said NO to the seismic testing to preserve their property from the damages that can be created by this process.  TGS is using intimidation and bullying to try to get the holdouts to cave in.  They will be finished with the testing BEFORE the court has time to hear the evidence against them.  

If Cougar/TGS approaches you to sign their agreement, ask them why you have to sign.  If they say that it is in your lease that they have the right to do it, ask them to show you the lease and where it says TGS has this right.  If they can't produce an actual copy of your lease, then they are probably not working for the company that has your lease.  

If you do decide to sign, make sure to get the addendum (Exhibit B) that gives you a few more protections.    Or you can write your own addendum.  There is an example at the following website:  http://www.hhmlaw.com/blog/seismic-testing-know-your-rights-around-...

If you have less than 100 acres, they do not need to place explosives on your property to see underneath it.  Ask them to sign an agreement that stipulates that no explosives are to be placed on your property.  The sensors are harmless, although the crews can still cause damage to your property when placing these sensors.
