We have been unable to find much information about DUX Petroleum LLC, a company offering to lease land in Washington County, Ohio.

It occurred to us that if we asked members of gomarcellusshale to help search, together we could learn more.

Please help search and post what ever you find.

The website for DUX Petroleum LLC is: http://duxpetro.com/ but there are no links of any kind - no telephone number or address, no "about us" links or any other information.

A search on corporationwiki.com lead to this link:

From them we learned that:

DUX Petroleum LLC was founded 10/25/12

It has a single member: Adam Popejoy

Its principle address is: 4403 48th St., Lubbock, TX 79414-3601

Because DUX Petroleum LLC is so new there is very little information about it. The only option may be to search for more information about Adam Popejoy and any of the companies he is associated with,

So, technically they can indeed not pay in the 120 days and landowners do not have any recourse.  The landowner can try to pursue DUX in court (where, in TX?) for damages but, in the end, they signed a deal with a new LLC that says it will pay but in reality doesn't have to.  

Even if the landowner does sue, and gets a judgement, the LLC has no assets and because its liability is only limited to the assets that it has, there is nothing to get.

Good luck to you - I sincerely hope it all works out as it will benefit not only those in Washington County but surrounding counties.  Since you have a lawyer who has inspected the lease, next time you speak with him, ask him what happens if they don't pay. 

Again, I hope it works for you though I think many on this board could benefit from knowing just where it ends up in such circumstances.

Naturally, if those already drilling in the area do well with their operations, those with rights in that area will all end up doing just fine.

I think you are all haveing a very good thought peocess on this matter. I have land in Morgan County very close to land in the Washington County Group's land.......I believe there is a very high probabiliy the lease Mr. Wells presented to the group is a lease designed/put together by a group of land owners from Morgan County after several months of work. I think you will find it very land owner friendly and possibly one one the best lease to use at this point. Not saying it can not be improvred, but pretty good for Land owners..... I believe what Markus is saying is very good advice, I am not an Attorney, but have a lot back ground in the "Busniess  World", consider taking heed in this deal......nothing totally wrong with doing business with an LLC as long as you understand some of the points Markus has made. You may win a law case in Ohio, but how do you collect money on an LLC in Texas?.....I do not have a clue how you would do that......but Attorneys will always try. The things I think one needs to understand in this deal/lease proposal are the following: very low probabiity that this LLC will ever develope/drill a well on the leased land. a very high chance they will through a lease try and tie up the ownership of the leased land for as long as they can while looking for a partner. They may very well come up with the money to follow through with the lease and then resell the leases to a Energy Company in 1-2 years.........make sure this would not upset you and you can live with this when your $4050 per acer, 18% lease is resold for say $8000/acer and 23% royalities... .. Just look at it from your personal ponit of view and what is best for you and your family, but understand what could/will happen down the road a bit.........Every one has to make their own decision.....lets just hope we have "all" the information available.........ALL IMHO

Stick with BP, Shell, Chevron, Antero, Gulfport, etc. Avoid DUX. Drill Baby sounds like a shill for DUX. If you ain't heard of a company and can't find a lot of information on the company, then Run Baby Run as fast as you can!

I wish I could help here but I do not know! My sisters husbands in charge of the farm and we only have around 50 acres. I just got to hear out the representatives. I sure am happy to find this website googling Dux petroleum though. Pretty nifty.

Also we signed in November if that helps anyone. I dont know if it does, but apparently Adam Popejoy comes from a Oil family in South Texas, I do remember that. 

Wishgard paid all of their clients in Washington Co who had clean title..  Over 6000 acres Paid Up.  Not fair to compare their results w/ either company.

Markus: Trust your instincts. Stay away from DUX. Stick with Antero, Gulfport, Shell BP, Chevron etc. Do not be a fool!

More on the Windsor Ohio LLC....part of of Wexford Capital LP....would appear to be a investment group that put the LLC together for this project. Middle people trying to make a $.......or several $'s.......All IMHO

An earlier post pointed out that Linkedin showed that Adam Popejoy was the owner of Ya Piping.

According to bizapedia.com Ya Piping is "not in good standing" with the State of Texas.

Several telephone searching websites indicate that there is no telephone number for YA Piping in Lubbock, Texas or anywhere in Texas.

By inputting the address into GoogleMaps https://maps.google.com/ and clicking on street view it appears that the company located at that address is A Plus Granite and Cabinets.

Sounds like DUX may be a SCAMMER! You have done a good service to prospective lessors who if they have any sense at all will not deal with DUX! If they do, I will have no sympathy for them.
