Can G&O co use electrical ROW with no compensation to landowner?

This may seem like a dumb question, and I a foolish landowner. I was presented with a strange proposed pipeline map several months ago, showed the ROW zig-zagging across my property, way too close to buildings, etc. Signed nothing, as this was totally unacceptable. Never heard again about this offer, received another that only showed the ROW crossing the back of our property - more acceptable. Now am seeing G&O peeps parked on our electric ROW and put 2 and 2 together - the original map showed the proposed pipeline following an electrical ROW. I am mortified. There is no way I want the pipeline this close to my house and barns. So far we have signed nothing. Can they make a deal with the electric company and bypass us? Considering the number of times trees have hit transformers in this ROW it just ain't a very safe place to have gas pipeline, no matter how deep it's buried...

Do you have a formal ROW agreement for the electric ROW?  If so, read it.  That agreement should tell you what is allowed and what is not allowed.

If people, not from the electric provider that has the ROW across you, are trespassing your property, I think there's a good chance you need to call the police.  At the very least you need to learn the affiliation of such people and learn their trespass excuse.

The electric ROW has been there for a long time, since years before we purchased the property. Thanks for the advice - I'm going to contact the electric company about this.

If you do not have a copy of the ROW agreement that is associated with the existing electrical ROW, I would obtain a copy (from the electric company - if they can quickly provide, or from your County Court House). You need to know exactly what encumbrances are associated with that ROW.

If there are still people on your property who you did not invite, I would suggest that you go and speak with them and ask them why they are on your property (and who gave them permission for them to be on your property). If these individuals cannot adequately explain why they are there, ask them to use their cell phone to call their Supervisor, so that you can speak directly to that person. If they are unable to convince you that they have a legitimate need to be on your property, I would ask them to leave - until you have been convinced that they have a legitimate need to be on your property.

All IMHO,

I signed a ROW for a pipeline which will follow an existing electrical ROW on my property, so the two can coexist.

You bet it`s a good idea to combine the two...an energy corridor, and no additional land is disturbed.

Don't necessarily disagree with you on this, farmgas, but it's where the electric ROW runs on our property that makes me upset about the idea of a gas pipeline there. I have no problem with pipeline in general, just want it not so close. The electric ROW actually makes one parcel of our property more valuable due to accessibility of the utilities for future building. Doubt a gas pipeline would add value. Really appreciate everyone's input and the conversation!

I am sure they could - just like the cable companies use the power lines.  Anything to make an extra buck and short change the land owner.   If you sign a pipeline ROW make sure it states that they cannot sublease the ROW to other utilities...

Kristen,

The electric ROW agreement will be your guide.

The one I have says the the electric company has the right to run electric, telephone and telegraph wires. They can NOT run anything else. These are a pair of towers coming North out of the Samis plant on the Ohio river going to Salem Ohio and other places. One is 175 KV the other is 345 KV. The agreement is dated Oct 1957.

A Pipeline Company has signed an agreement to go through on the other side of the 1/4 section. 1/2 mile away.
