I am a landowner in Guernsey County with a 4 1/2 year old Oxford lease that is set to expire in about 6 months.  I, and apparently many others, have just received an offer from Eclipse to extend the lease for 3 years for a generous one time payment of $100.00 and the same 12 1/2%  royalty (but no line charges).  The extension provides for the grouping of 640 acres instead of the 160 acres in the old leases.  I had hoped that Eclipse would treat the landowners fairly, in contrast to the Oxford way, but apparently not.  The landman, who called me, reminded (threatened?) me that Oxford (now Eclipse) is still drilling its shallow wells to hold them by production.  According to the DNR records almost all of these shallow wells have only the tiniest of production of oil or gas or sometimes only salt water or nothing.  My neighbors tell me that Oxford comes in, sets up a small rig and drills for a few days and leaves.

 

One leverage the landowners have by not signing the extension is to deny Eclipse the right to put together the necessary 640 acres to drill a deep well.  If enough people do not sign the extension maybe we could get a realistic offer. 

 

Has anyone on here received a similar extension "offer"?  Is anyone actually signing these things?  Does anyone know of any law suits or other methods to stop this bad faith drilling of the shallow wells?

Regina - just was informed that due to a top lease being signed with Antero 2 years ago, Eclipse is now rescinding an offer of 1000/per acre 12.5% gross and wants me to sign your tweaked lease numbers. Our attorney told us that drilling is planned for this Monday. Seems we get screwed any way we turn. Have you heard of any action being taken recently on your property?

 I haven't heard anything recently, however they wanted to check our water and my husband refused to let them check it. We will not sign anything further  without an attorney who is familiar with mineral leases checking it thoroughly and also checking with neighboring landowners. Where is your land in relationship to our property. We are on mcburney rd. Millwood twp. Can you explain  what a top lease is?

 I haven't heard of Antero before.do you know who signed with them. was it Oxford or a landowner.  Would you mind sharing the name of the attorney you are using to represent you? We were looking for an attorney in the area  Do you know where is the drilling to take place?  Sorry I have so many questions, but I believe that information is power and all of us landowners need to know what is going on with other landowners in the area. My property is bordered by mill and sycamore as u turn south in salesville. 156 acres. Antero and some landowner association 2 years ago, held a meeting at the lauglin center. they gave us 10/aces just to attend. Now oxford says due to doing that they will put a well on our property to lock us in, initially for the 100.00 signing. my attorney now says they will give us 500.00 for good faith. Am coming down that way tomorrow to talk to some locals about what is going on. will you be around? I am totally nconfused at this point, and do not feel totally safe with my representation. I mean, why are the offering me 500 when they supposedly do not have to do that. Good faith??? Hardly, I think.

Way to low of an offer.  Don't sign.  Call Jennifer Garrison and see if she is doing any additional landowners groups and get everyone together with one of these old leases.

 

yeah.. so she and 5 others can get a percentage of your lease.. are you kidding me..
