I have a well pad on my place.  In addition to the buried pipelines that will be going to go to a gathering line, Eclipse is now going to put in a temporary water line. "Temporary" means they will have the option to keep it there for five years. It will be on top of the ground.  They are offering $4.00 a foot. Anybody have any ideas on what this is worth?

THIS IS WHAT THEY ARE COUNTING ON. You might not get royalties, but they arent making money either. To be a solvent company, they must make money. They would have paid more. If any of them ask me, I'm charging $25K per acre, or they can buy mine.

Yes, this has been my experience. They will easily double the price they are offering for something.  Then getting more is a bit of a fight but they will do it. That first offer is purposely way low in hopes that people will take it. So if they pull out or cut you out of the unit because you asked for more (not likely!), so be it.

When I needed to negotiate a pipeline replacement project last March, the closest thing to my situation seemed to be a temporary water line, since the work on my land was also to be of a limited duration. At that time I found that some were being paid $5 per foot for a temporary water line so I used a number that was similar. Since the project was scheduled to last no longer than 3 months, we negotiated that I would be paid on a per diem basis for any time beyond the 3 month date which did indeed happen. To be paid $4 a foot for 5 years seems way low to me since I was paid a little mor than that for 3 months. Granted, the work on my place was more dramatic but after three months, it is done and over and will be back to normal as soon as the grass grows. What are their options? If they really need you, my experience has been that they will find the money.

Charge them $25,000 per acre. What if you need to sell in 2, 3, or 4 years. With that present, no one will be willing to buy your property. It is also an inconvenience to the use of your property. STOP SELLING OHIO SHORT!!! From now on, any ROW should be $25,000 per acre. If they need it, and everyone says the same, they will have to do it. Also, band together against OHIO, who BTW sold us all out to the oil and gas industry by allowing the PIPELINES to not be public record until they were being put in and inspected.... ie. they prevented property owners / mineral owners from knowing when and where the lines were going by not making it public record. A PUCA person told me this.
