A land man who is representing the oil and gas industry is asking to buy our farm. He stated that they would like a 140 acre tract. Also they are not wanting to buy the minerals. He would not tell us who the buyers are or what their interests are. Has anyone else been approached and does anyone know what is going on. We are located in Ellsworth district of Tyler County, WV.

The time is here and soon the market will see. I believe something is in the air and it may land in Ellsworth tax district. Get organized and get your neighbors together, join a landowner group and stay current on the market for all land asset values, above and below the ground, be it pipeline, timber, commercial space, housing, your water rights and usage or below with the multiple formations of shale and coal rights.
Rumor has it that a meeting is heading your way for this very purpose. Stay tuned.
I agree - it sounds like someone is prospecting for a major plant or site location; I suspect a third party got wind of plans by a major company and is trying to create a package to sell to them, probably including local knowledge and planning beyond just real estate. I've seen it happen in other industries - you are better off waiting until a bigger company starts sniffing around so that you get more money instead of the middleman getting it.
Okay let's think on this one. The farm in question is it already leased? If that be the case a flip of the lease might be the desired outcome for total mineral rights. Another if the farm is sold without minerals how long could it go without anything being done before the mineral rights might be transfered back to to the surface owner?
Billy, He told us we could keep the minerals and everything on the land could be taken down and sold or kept by us. He said they only want the land. Yes, our minerals are already leased. What do you mean about the mineral rights transferring back to the surface owner and a flip of the lease? I am not familiar with these things. Thanks.
I think Billy might be thinking of Ohio which has some law about mineral rights reverting to the surface owner if a long time passes from the severing of the mineral rights and nothing happening (like leasing). I am not familiar enough with that state's laws to give proper information, but I know that WV does not have anything like that.
Ohio and a few other states have a Dormant Minerals Act; in Ohio, after 20 years of no oil and gas activity, the surface owner can file papers so the rights revert to the surface owner. It was intended to clear up very old leases with companies that have shut down. WV and PA do not have a DMA.
You are correct upon my train of thought minus the ability for an attorney to pull a fast one.
For anybody selling or leasing now, you MUST have all legal documents reviewed by a lawyer, particularly when they make claims like made above about keeping minerals rights and moving houses (I've never heard that one before; did I understand it right?).
Yes, Jonathan, we have several large barns, silos etc on our farm, he said Take what ever you want we just want the land. I agree, never ever sign any thing until your attorney reviews it. The latest in this story, The land man gave us and ask us to sign a survey consent form, to allow Alpha Field Services, LLC to come onto our property "to look around" to see if it is suitable for their needs! We did take it to our lawyer for him to review it. We are not signing it, not interested in getting involved with this, What ever it may be. Thanks everyone for your continued help.
