HB4639: Worse bills yet against mineral and property owners (call now to defeat!).

These are the worse bills yet against mineral and property owners.  Need to contact your state representatives now to oppose HB4639 and SB646 as they are on first reading today and third reading this Wed.

These bills:

  • allow 49% of leaseholders to be forced pooled with NO compensation
  • Take away ability of land & mineral owners to sue for damages
  • Force mineral owners to sue leaseholders for any payments for their minerals
  • Eliminate ability to negotiate depth of drilling or target formations in leases
  • Eliminate any surface protections for landowners
  • Allow deductions to be taken from royalty payments

Need to call now as they will be voitng Wed. Feb.24.

WE MUST NOT LET UP! PLEASE CALL OR EMAIL THE MEMBERS OF THE SENATE JUDICIARY COMMITTEE LISTED ABOVE NOW AND URGE THEM TO VOTE NO ON SB646 - THE FORCED POOLING BILL! THIS WILL BE DECIDED BY THEM TODAY!

The Senate Judiciary Committee has put off voting on SB646 until tomorrow morning (Monday, February 29, 2016) at 9:00 AM. EQT Corporation forced a vote today and the best they could do was to get a tie not to end the bill but continue it until tomorrow. 

The Farm Bureau, The West Virginia Royalty Owner Association and the Land and Mineral Association should be able to speak tomorrow before the vote. The Farm Bureau was offered several incentives to go along with the bill, but they refused to support it. 

At the urging of Senate President Bill Cole who was present at the meeting, four Senators changed their minds and decided to vote for the industry bill and FORCED POOLING. They are Republicans Charles Trump and Kent Leonhardt and Democrats Corey Palumbo and Mike Woelfel. Please call or email these Senators and urge them to VOTE AGAINST SB646 - THE FORCED POOLING BILL!

Even if the Senate passes the bill, can it become law since he House will not pass it?

  Looks like SB 646 is no longer.  The Senate Judiciary adjourned without voting on it this Monday morning and it has not been put back on the agenda.  SB 596 failed on the Senate floor today with a vote of 23 to 11.  Great work everyone!

Help is still needed on SB508, which has been sent to the House Judiciary.  This would destroy a more than 200 year law that allows citizens the right to file "Nuisance Suits" against neighbors or companies who harm their property values or their right to the pursuit of happiness on their property.

So please call your Delegates and send email to the House Judiciary to oppose SB 508.

Although it appears that SB646 (THE FORCED POOLING BILL) is not going anywhere after last Monday, we must still remain vigilant until the end of the current session to make sure that neither the House nor the Senate tries to introduce or pass new or amended legislation that contains the same language! Please continue to contact the members of the Senate Judiciary Committee to express your opposition to Senate Bill 646! Please Say NO TO FORCED POOLING!

I also oppose SB508 – The Nuisance Suit Elimination Bill – This bill is currently in the House Judiciary Committee for approval after being approved by the Senate. This bill eliminates property rights in a wholesale fashion and if you own any surface property whatsoever, unless the driller is in violation of some State Law or regulation, you will have very little recourse in Court. Please call the members of the House Judiciary Committee today and urge them to vote against SB508.
