I haven't seen anyone talking about what's been happening with Chesapeake and the Rokisky Group on here and was wondering if anyone else was aware of how many people got turned down on that deal.  I heard only 80 checks went out.  I know that we were told that anyone who's contract was expiring or up for extension by the end of Aug could be in on that deal but they came back and excluded everyone who's contract they think they could extend at the $15 or $30 amount.  They were signing up people all day and if they only sent out 80 checks then alot of people didn't get the money.  Rokisky is suppose to be filing individual law suits and Frankovitch is filing a class action law suit about this.  I was told that any extension had to be negotiated when I signed my contract and again when it was flipped.

What Rokisky Group are you referring to b/c there were several?

Is this WV or Ohio Group?

We are in the group from wv,  I have been trying to get a hold of Rokisky but nothing yet.  They told me that they were still recieving checks the last time I talked to them but it is past the deadline,  We did not recieve any kind of declined letter either.

I'll let you know if I hear anything negative.  My property is in WV.

Thanks,

My property is in WV.  They are trying to hold everyone under paragraph 19 on their old leases when they said they would take them into the group if their contracts were up for renewal before the end of August.  I could not get anyone to call me back from Rokisky's office so I called Chesapeake myself and talked to one of their lawyers and they offered me a $500 signing bonus but then sent the check to Rokisky's office and he wanted to take 6% of it.  When they called me to come in and sign for them to get the 6%, I told them I was not accepting that deal and ask why they were sent that check anyhow because they didn't even work on it and the only deal I had with them was the one for $4500 for them to get any cut out of anything.  I wonder how many people actually got turned down and know there is a recourse for them and not to just accept whatever someone tells them they have to take.

That's a shady deal.

Could you summarize what paragraph 19 says.

I'm unsure of something -when you say "They are trying to hold everyone under paragraph 19....." who do you mean by 'they'? Chesapeake or the lawyer's office?

She means Chesapeake, read paragraph 19 on a standard lease. These gas companies fooled alot of people with this paragraph.

Paragraph 19--In consideration of the acceptance of this lease by the lessee, the lessor agrees for himself and his hiers, sucessors and assigns, that no other oil and gas lease for mInerals covered by this lease shall  be granted by the lessor during the term of this lease or any  extention or renewal thereof granted to the leassee herein. Upon the expiration of this lease and within 60 days thereafter, LESSOR GRANTS TO LEASSEE AN OPTION TO EXTEND OR RENEW UNDER SIMILAR TERMS LIKE LEASE.   This is how they decieved people  with one little sentence.

Wow.

Thanks - Corvette.

I deleted my previous reply to avoid confusion about para. 19

Corvette,   Look for a statement that gives the landowner the right to accept a higher amount from another company. I have heard news that some landowners had the right to accept a higher offer due to the lease wording, it could be in another paragraph. I would think that CHK leases woud have the same wording.

The other option would be to join the Rokisky Class Action suit since this would have been a "Bad Lease" as defined by Jeff. With the Gas company knowing what was under your land they should have offered you a fair price on the bonus and royalties. Good Luck in getting this resolved in your favor.

Ron I took my lease to Rokisky's and I was told to be patient and try to join a land group. I don't believe there are any active groups in my area. Thank you for the  Good Luck wish--I'll need it!
