If the plaintiffs say a pipeline at or below 20 feet encroaches their mineral interest for coal or aggregates, then I think I'm misunderstanding their point because I don't know of pipelines that generally transport gas that deep.  I'm not an industry expert so what am I missing here?

I thought they tried to bury pipes as shallow as possible. Less digging the better.

What is the legal definition of "surface"? This suit could cause a tidal wave of trouble throughout the play , if it is won. Could it even halt any current development elsewhere until it is settled? Sounds like a frivolous lawsuit to me , but what do I know.

Mark, not sure precisely , but Essroc owns the old Bessemer Cement Co. located in Bessemer,PA.

Like most coal & limestone companies , I suppose they scattered have mineral holdings within a 5 or 10 mile radius from Bessemer.

This suit is something to stay abreast of as it could have widespread implications for all of us.

I could see how it's possible that any pipeline could cause a problems for planned mining sites, especially strip mines.  There's a lot to consider with this.  The judge will be earning his money wit this case.

I think the mineral owner then should be forced to compensate the surface owner.

Trapper, in light of the lawsuit it is probably in my best interest to delete my earlier comments. I just read a copy of the legal filing, and while I am not listed as a defendant, my property is listed in the document. Sounds like this might get messy.

Anyone have any ideas on how Patterson well is doing

I hear two Patterson wells are being listed as inactive , but two have been producing & selling gas. I am thinking (hoping) the two wells that have been dormant since drilling are the ones being listed as inactive. I am also thinking these have been dormant simply because they are wet and no infrastructure is in place to handle that yet. Purely speculation on my part but it makes sense. Anyone else care to offer up some info?
