My family owns mineral rights in Guernsey County (I believe in Wills Township near Salt Fork State Park).  We are under a current lease with Enervest and it states valid until there is no production.  Our royalty checks have dwindled down to really not much.  Any idea if these types of wells/acreage/land are being offered opportunities from companies like Enervest to drill this new technology?  Or are they staying away from low production marecellus shale and exploring other areas?  Also, being a mineral right owner, do they contact just the land owners or are they required to contact us a well?  Any info is appreciated.

There are at least 7 Utica/Point Pleasant wells drilled or being drilled within 10 miles of Salt Fork State Park.  The Groh well, that had good initial press release numbers, is 8 miles east of Salt Fork.  Enervest can drill horizontal wells or they can sell their lease to other companies that may be interested in drilling.

Interesting!  Sounds like where we own mineral rights is in a great area!  The current well we have held by production was put in place back in 1974 I believe...so a very old well.  How do we get a new lease with Enervest with the utica?

If your receiving checks the co sending to you owns the right to lease them out since you are held by production, unless your lease has language stating which strata they control. Many say to the center of the earth, while others give more hope to the mineral owner.

I need to find out the details in regareds to the language of the strata they control.  Is the only way out of the current lease to hope no production comes soon?  If Enervest, or another company wants to put in place a horizontal well, do they have to contact us as the mineral right owner?

Have a knowledeable oil and gas attorney (or attorneys) review your lease and tell you where you stand.  Very few leases are the same and they can be quite confusing. 

Do not count on "no production comes soon" because if the company producing your well holds the rights to the Utica/PP they will most likely do whatever they can to keep the well "producing" so they control the lease which is quite valuable.

more than likely you're held from surface to center of earth.  Id definitely have someone check out the lease for you.  Some people I know have worked with a company called americas choice realty.. even though my friends were held by production on an old lease acr still found buyers intersted in buying.  seemed simple to me because acr went out and found them a few offers and my friends chose the best one.  they sold half of their interest and was able to cash in on the boom.  not sure if you're in the same boat but it sounds like it.  my friends liked working with them because acr wasn't out to get them, they were there to find them the best offer.
