Yea votes stand with the land owners of Pennsylvania, Nays do not!!!! We landowners need to support those who support us. We cannot forget these people who fight for what's right for the people of Pennsylvania. The fight isn't over yet.

With ten acres, no building, but you plan on building, I would insist on a non-surface lease.  Otherwise, they may run a pipeline or road across it and ruin your plans.  At the least, plot where you want to build and insist they stay 500' from that point.

The industry is constantly changing and it is hard to predict future activities that need controlled.  One development I wish I had foreseen is that a couple companies are drilling on the edge of a unit, drilling one well each direction, and HPBing 2560 acres with one pad.  I would certainly stop that practice. Demand all pads be located in the center of the unit so that 1280 acres is the max HBPd.

Another new development is that many companies are converting all equipment to run of nat gas. Drilling rigs, compressors, frack pumps, electrical generators, and more are all being converted to run on gas from the wells. The trucks that deliver pipe, sand, cement, rock, water, and equipment will soon run on gas as will the earth moving equipment for roads, pads, pipelines, etc. That would add up to a lot of fuel.

I would demand that all gas be metered and the landowner get paid full royalties on all gas produced including that used onsite or off by the driller and/or its subcontractors. Not fair for the companies to get free fuel for all their equipment.

The last suggestion is to require all equipment to be in compliance with the federal Gas STAR program that minimizes off gassing and pollution.  I wouldn't want a tank farm off gassing fumes on a hot summer day.     http://www.epa.gov/gasstar/

Can you IMAGINE what will happen to Royalty checks once this stuff takes place - there won't be any (in fact WE might owe them...)...SO go to this discussion & read through it...

Knowing what you know now, if you had the chance to change anything about your lease, what would it be?

I have one i haven't signed yet and plan to meet with a lawyer to review it next week and hope to take notes from those who have been through this process already.

NOT 'retroactive'? - WRONG.  - America's Pa. Landowners didn't 'already write off' their LOSS & are 'fine with that. - NO-NO-NO.  & 'they aren't asking for RETROACTIVE payment' - WE'RE NOT?...and 'they are fine ONLY 'going forward.' - WE ARE?...

NO. When G/O Leases are signed - the LANDOWNER is led to think that a Royalty of 12.5% (minimum - depends on the Royalty promise structure...some are higher % Royalty...) is JUST WHAT it says it is - 12.5% PERIOD.

IF you buy a cow, pig, sheep - or any other farm animal - OR wheat, corn, straw +++...from a farmer...He tells you the price you will pay/pound. He doesn't THEN turn around - after you make the deal & say - well, it cost me this much to feed the animal, to clean up after the animal, to 'house' the animal, to then transport the animal to the butcher shop, and the separating the cuts & packaging the cuts...so now you owe me 'x$' more. WHAT?

You go to the gas pump - it is a set fee - right?...no 'transport fees, refining fees, +++' it is what it is what it is. You don't fill up - 

Basically - we're up oil creek with NO paddle! & even IF/when we DO find that paddle - it's gonna' take YEARS to get even an inch 'upstream'! - boy , they (G?O Co. have this locked up (US - locked OUT!) - lock, stock, & barrel! SURE - it's in THEIR best interest to CHARGE US for their 'services' & NOT be able to address wrongdoings to the LANDOWNER.

I don't know how this would work, but it MAY be an idea...how many individuals have been getting Royalty checks for a period of years? Did you even KNOW of 'deductions' taken out by your G/O Co.? Interesting. I don't know about you, but I noticed a strange drop awhile back & wondered what it was from...WHY was this? - and don't say to me - WHY didn't I just call up the Co. & ask?

Here's why: Any of you trying to get a 'straight answer' out of a G/O Co. ever GET one? NO sir...only a sweet little run around from secretary to secretary & you leave messages.... So - you leave a message concerning WHAT you are hoping to get answers to...then finally (maybe?) you get an 'answer - AFTER they can look things up, analyze it & figure that BEST ANSWER (for THEM!) that will answer you question...and you're left hanging out to dry. Better luck NEXT time (fat chance!)...that is just a scenario of 'run around' - I'll bet that there are a MYRIAD of stories that can come out of the woodwork sounding somewhat similar to that. *YOU CAN'T GET A 'STRAIGHT ANSWER'!

HEY - THAT would be a good 'discussion' - *LANDOWNER 'beefs' about trying to contact G/O Co.'s about G/O problems & what they deal with...   or something to that effect...WHAT have YOU personally HAD TO (been forced to...) deal with concerning G/O Land & Landlease problems - concerning G/O wells (both Conventional AND UNconventional...)???

One of these days - we'll pull up at a gas station to fill up - expecting to pay 'x'/gallon (it's POSTED - right up there on that BIG sign...for everyone to see...). Let's say $5/gallon. You fill up - even 20 gallons in your go-buggy...that's $100 even. BUT the bill is for $189! - WHAT?! Well, sir - that IS the price/gallon, BUT there are additional fees that are added on to your bill - there's transportation, refining, +++....see here?

TODAY, YESTERDAY, & TOMO?RROW...:

*you own the land

*you lease the land for G/O 'rights to drill' - 12.5% Royalty bonus (possibly +%...)

*wells drilled, G/O produced - your 'gas' is your pig or cow'...

*Gas Co. have us licked - they know it & we're up OIL CREEK...slick PIG! (ever try to catch a *greased pig?)

*The 'standard' is NOW the 'G/O Co. owned *subsidiaries that THEY OWN...they are just now classed differently as 'separate parts' - transportation, refining, +++ ***OH that one fella DID mention ***WHEELAGE*** - Gas *PIPELINE landowners - take note === ***WHEELAGE***. mentioned!!!

They have themselves covered quite WELL. Their 'SUBSIDIARIES' are essentially *PART of the WHOLE* - and should be treated as such. THAT is a major part of the problem (as a whole...). Company 'X' has under it's own belt - a NUMBER of *Subsidiaries* who handle DIFFERENT PARTS of the matter of Refining + 'the product'. X1 is the first step, X2 handles the next step (for a fee unto themselves that they write off of course...), then X3 does the...and X4 this, that, and the other thing...and bingo X5...to market, to market - to buy a FAT PIG (WE being 'the pigs'...). Doesn't matter HOW you look at it - cut the cake...

Bottom Line: We're ALL up 'OIL CREEK' without a paddle! (I'd be glad to honestly learn OTHERWISE!)

This ain't gonna' get cleared up in a courthouse, folks. In fact - that's just where this is getting FUEL TO the G/O Co.'s 'fire'.... Don't you get it? We're really skrewed here - skrewed TIGHT to it...and the 'government' is NOT going to help out. It's all 'lip service' - jibber-jabber...and the G/O Co.'s KNOW just what IS 'going on. I can only pray that I am wrong - I would LOVE to be wrong here. Bottom line: It's already IN their coffers - and if they don't have to 'give it' they won't.

Yes - I use the word 'skrewed' because THIS treatment of LANDOWNERS is just that - and I'm not gonna' candy coat THAT.

We were all 'offered a lollipop' & promises that it tasted good...and it was & did at the time...NOW the tides have turned & the PIRATES & BUCCANEERS are HERE to STAY! (but we still have our land! - ha,ha!! WHAT a JOKE - joke's on US!). Talk about the 'WOOL BEING PULLED OVER OUR EYES'...YIKES.

Here is a tentative thought in this uphill battle. You get a Royalty check - correct? It lists the wells - production, percentage portion, +++...I don't EVER recall getting a statement with ANY listings such - concerning 'deductions' - or a LISTING of deductions...and IF there were deductions being taken - *it was NOT KNOWN by me.

NOW I am seeing a 'listing of deductions & amounts'...wonder just how long this HAS been going on. Anyone else? Do you see what I'm getting at? WELL - I'm thinking that at one point in time - NO deductions were being taken...and NOW they are. THIS may be a 'sticking point' in their equation of 'NO RETROACTIVE' distribution. WHY are they now 'listing/posting' what they are STEALING - and they didn't before? 

Maybe because they weren't taking deductions back then - and this JUST STARTED?...

...think about that - IF you didn't KNOW that any deductions were being taken out - HOW can you dispute what you have NO KNOWLEDGE OF??? (that's theft.) -AND- if you didn't know about it - how could you forgive it? In a way - you've got them either way. One can NOT consent to something that they have NO knowledge of (I would think so, anyway...).

QUESTION: WHO out there in 'Royalty Gas Land' agreed to NOT getting re-imbursed for any & all 'deductions' made to their Gaswell Royalty check? Not me. I didn't, did YOU? WHO are they even talking about?.... WHO SAID that WE are 'not asking for *RETROACTIVE Royalty Payment* - and that we are 'FINE' going forward??? --- WHO out there - what LANDOWNERS (getting shafted...), WHERE??? come on - IF you said that - share with the group....

LANDOWNERS need to be PAID IN FULL (*With INTEREST and some penalty...) for damage done - that's simple enough. ***Right is Right & Wrong is Wrong. - straight up & simple.
