M&P BEING SUED / CLASS-ACTION SUIT AGAINST HALCON, M&P & CX

 

Hello everyone:

                         I have not posted anything on here before. I have always just read the comments of others. I thought I would just post some thoughts. After being patient for 8 1/2 months I still have no answers like others in the south east Mercer County area. Is Halcon going to be held responsible for their actions? Are they going to be made to pay for the contracts they signed for? How qualified is M&P when it comes to representing the landowners of group 4 against a company like Halcon with deep pockets. Will we get an honest effort from M&P or will they make it as short as possible and except less than what we deserve to mitigate damages on their behalf. I have just read, in detail, the civil suit against M&P by Terra Energy LLC. Now it seems to me that the landowners not only have to worry about being pushed around by an unethical oil & gas Co, but now we have to worry about the real motives of the law firm we have to represent us. Are they going to treat clients like they treated business partners? I think if given a chance M&P will come back to the land owners after any legal actions against Halcon with a bogus report how they couldn't do much and if we continue it will tie up our lands for years, of course due to a half hearted attempt at getting us what we legally are owed.

                        I only have this attitude after listening to M&P for 8 1/2 months tell us how important it is to stick together as a group but they will break up the group at the drop of a hat to sign a little chunk to this O&G Co and another chunk to a different O&G Co. This sticking together only benefitted them by having all of us available to them for whatever size of lease they could get from any other O&G Co. After seeing an E-Mail to Terra Energy Advisors LLC from Jack Polochak describing how maybe Terra Energy should  get some leases signed by an O&G Co that are less than desirable for landowners to make it look like A Co he was partnering up with was successful in the oil and gas leasing business. That just shows me that he will sacrifice his clients profits to improve his and his associates. I think everyone should read the Lawsuit especially the landowners of group 4. Maybe I am seeing this in a sinister way and I am just swayed by how the rest of the world does things these days. Here is the link to the Lawsuit. Perhaps CX Energy and their representatives have sought legal advice and been told to remain silent! Were I an attorney, that is exactly what I would tell them. Interesting that one or more CX representatives have recently posted that no landowner should sign a "lease" or other documents without consulting his or her own attorney. They surely were NOT advising landowners to do that when they were signing up thousands of acres in Mercer County with the Mount Jackson 4 group. Indeed they were telling people that they had to sign promptly and 85% of the acreage had to be signed up by a deadline for Halcon to accept the deal. The deadline was a very very short period.

Fang: You are correct in your statements. There is a landowner lease form and a lease form when the landowner has counsel. Although the economic terms may be the same, the absence of a Pugh clause alone can render one's mineral estate valueless. What good are minerals if they are not produced? We tell our clients that the bonus is good but that the real value comes from the production royalties.

Interesting interactions indeed....I would be surprised if you were off base in your suspicions Sam.

Just to keep everyone up to date on information I got from M&P Today.  I returned a call To Jeremy, an attorney with M&P, today. Soon after my call the screening process began and there were no attorneys to talk to. The person Jeremy who answered the phone was not the attorney Jeremy but probably a paralegal or an office worker to handle and divert calls. I asked about the posting on the M&P website of a lawsuit against Halcon. Jeremy said it was not a lawsuit filed by M&P but a lawsuit filed by a law firm out of Pittsburgh called Jones and Greg with a phone number of 412-261-6400 and 724-981-8000. The suit is supposed to have been filed by landowners in Jackson group 4 as a class action suit against Halcon according to the Jeremy at M&P. I asked him why the rest of the landowners were not informed of this suit against Halcon and he said it was disclosed at the meeting in Grove City and a mass mailing went out letting everyone know. I never received an E-Mail or a letter via USPS. And unfortunately I did not make it to the last meeting at Grove City. After reviewing a members run down of what happened at Grove City I don't think he would have left out that important tid bit of info. I let them know I would be calling Jeremy the attorney back tomorrow.

There is a class action suit filed against Halcon. It is pending in mediation and was filed in November.

More important, pump jack, is that the folks don't have to join the class if they opt out.

  

Wouldn’t it make sense for all of Jackson Group 4 to call this law firm and add their name to the list of disgruntled landowners who got shafted? Is it with the Jones & Greg Law  offices out of Pittsburgh

I'm not sure what kind of notice went out to the public but I would encourage those who are similarly situated to contact the law firm. http://www.jgcg.com/

I hope Mr. Brink sees this. He has access to Federal Court Docket and possibly to Allegheny County Court filings also. If there is a class action, the plaintiffs' attorneys would want the class to be as large as possible to maximize the recovery. Of course the requirements to certify the class would have to be met. (I may be wrong on this as I am not an attorney.) I think Mr. Brink or other attorneys who have commented on this thread should be able to comment about class actions in Pennsylvania. The rules may vary depending upon whether the action is filed in state or federal court. If a class action has been filed against Halcon, it would be nice to see a copy of the complaint filed on this site or a link to it.
