I have heard it might be possibkle for New your landowners to sue the state for not allowing fracing. Is it possible?

The way I see it:

NY Joint Landowner Coalition is looking to sue the state for four different "takings" cases. If they are successful, a class action lawsuit would then commence, using these four cases as precedence. They would open this class action suit to all NY landowners at that time.

 

I dont think it will get that far. As upside down as this state appears, I cant see them risking this enormous liability (my guess is 6 Billion dollar lawsuit). They will delay as long as possible and then commence drilling permits as slowly as legally possible. The enviros will continue searching for the magic silver bullet to kill fracking. But, I dont believe that bullet exists. My prediction is that permits will begin sometime in 2013, at a snails pace. Drillers will be very apprehensive to jump into this quagmire, all limiting the value under our land. Sad indeed and I hope I am wrong.

Todays Elmira Star Gazette said no drilling allowed till 2015. It sure would help make some jobs around here in Tioga County if they were to start drilling there

That 2015 date is from a bill that passed the Assembly, the NY Senate probably wont pass their bill to move this forward. Even if the Senate does, Cuomo could veto the bills. It is hard visualizing the Emperor doing such a thing. Any legislator that voted for an additional moratorium should be voted out of office. Just to keep score, the vote was along party lines - democrats for moratorium and republicans against. Keep watching, a prayer or two wouldnt hurt either.

I feel for all the landowners not getting to share in the royalties and hope the gas companies still want in there
