State of Ohio ex rel. Claugus Family Farm, L.P. v. Seventh District Court of Appeals et al.

Clyde A. Hupp et al. v. Beck Energy Corporation and XTO Energy, Inc

This is all I know, it is straight from the Supreme Court Calendar.  Notice also that another case out of Monroe is being heard that day.

Yes, the Justices were focused on the Claugus case.   But five lawyers in a little over 60 minutes made each of them appear probably less competent than what they probably are.  The Hupp lawyer did however, I thought outline how a paragraph in a lease which a landowner may think is good can be totally nullified by a later paragraph.  Overall it did appear that the Justices weren't interested in Hupp vs. Beck Energy.

Anyone know who  the law firm was that wrote the leases that Beck used?

seacherone,

It's a boilerplate lease. It has been used, in one form or another, for over 100 years.

I believe the first one was written by Dewey, Cheatum, and Howe.

The above article using quotes from the attorneys shows where each of the sides stand on this issue.  Notice that one attorney says its been this way for over a hundred years and needs to continue.  Strange I can think of a number of things in US society that were long standing but were finally overturned or outlawed. . .denying women the right to vote comes to mind very quickly as one example.

The above article is from a Twinsburg Ohio newspaper.
