Okay, here's a hypathetical question.  The DEP would not, could not monitor and regulate well spacing on the Marcellus Shale in Pennsylvania because it was above the Onendaga layer, as I recall.  The Utica Shale is below the Onendaga I believe.  This should put it under current DEP jurisdiction to control well spacing (unit size) if they so choose.  Will they step in and regulate?  Also, I cannot see how units set up for the Marcellus should effect the future Utical well units at all.  They are entirely different layers and geologic structures.
