Ok, just got the papers in the mail today. So we have a lease that says no post-production costs. Chesapeake took it out anyway. wait though, there going to give us back 50% prior June 2014, and a whooping 34% after that. Isn't that like robbing a bank and giving half and less of it back and not going to JAIL. Something is wrong. I'm opting out, how about you?

Hard to see how that is a reasonable settlement for anyone other than attorneys.

Also just got papers with the mumbo jumbo.  Opting out seems like a good choice.

That was my thoughts as well...opting out...the attorneys always make out..those of us who own the gas getting screwed.

      You left out the fact that CHK gets to continue stealing 73% for post production costs.

I don't think this is the same as Robbing A Bank. It's more like using a contract to steal the money from the bank, then using the court system and lawyers to Launder The Money.

These are gentlemen at work in a corporation, they own people in high places, you have to treat them with a little respect when writing about their corporate strategies, for now.

Tomorrow? Maybe some prison time will be more appropriate.

Thats a good one. Do think that if enough people opt out, the proposed settlement may be dropped? 

This appears to be a small settlement, especially considering the attorneys are getting @ 6 million (that $500,000 for each of the six firms/attorneys. Moving forward, Chesapeake will still continue to rip us off, Any thoughts about possible alternatives? If we opt-out, what are our options (sue individually, etc.?)

My family and I also received this notice. In fact, my brother and I are Co-Executors of our father's estate which included a lease with Chesapeake. We have council representing the estate and like many, ours has the no deduction clause. We are not receiving any checks from CHK and haven't for 6 months. How do you explain to your beneficiaries, your siblings, 2 of which are sisters that have been battling cancer for the past 10 years, that have no income other than welfare or disability income, that there is no chance of receiving any money in the future IF we do not take the settlement.  I DO NOT wish to settle as I am a person who believes in principals and frankly CHK IS stealing and getting away with it. Settling is WRONG.  But the only option is to settle OR opt out.  If we opt out, 1) we would have to foot the bill to continue to retain representation; 2) how many years could this go on; 3) would the outcome be in our favor; 4) where would the money come from to fund the suit; 5) would my sisters still be alive IF and WHEN we MAY or MAY NOT be successful? It sucks!! The damn court system is so bad allowing years and years before any decision is final and life is just too short. Paying attorneys, whether to follow through with class action suit or privately is no different than paying for other services when you need a professional. The ultimate decision based on what you are dealt with is a personal decision. I think we all agree CHK is dead wrong and must be held responsible. I just have to take care of my siblings and my responsibilities the best way I can. If anyone can provide any indication that there is another way, please let me know.

You ask for another way. An Option is to file suit representing yourself. It is not hard to file a law suit nor is it expensive, if you follow this course. Lawsuits can be filed over the internet in certain counties, and you can obtain the court  filings of other suiters also over the internet at no cost, and use them as a guide for your own filings. The court filing fee is usually under two hundred dollars, and is an advance against future costs. Why not ask the court clerk in your county about the time and cost frame before you give up. As for taking years and years, you will know whether  you have a good case within a few months, and could see a trial date set before a year. If your case is strong you have the option to settle.

Got the same proposal and it is unsatisfactory. I spoke with others who feel the same.

It would seem to me that enough people opt out and coordinate with each other they can form their own group. Just saying.

Which Suit is this?

There are two new suits in the NE Ohio area that are currently seeking class status, issues no doubt similar to yours.

I would be very interested in seeing your offers -  I'll bet they are pathetic, maybe not even more than 2nd or third proposals.

The problem with class status is that my lease is not your lease...Folks bound together like this may have to be done differently. Class action rules can keep our interests from being aligned as we need to be.
