what is the going rate to allow testing on your property? we just recieved a letter from TGS wanting to run seismic on our property . thanks for any help    S. Keller

She was from TGS. We didn't reall give an answer the first time, she spoke to y wife and left an agreement. She called back and said American Energy Utica (Our lease holder) wanted them to do the work. She then emailed me a letter from an American Energy saying so. She said work was to start in a few weeks.

I was concerned for our water supplies. She hand wrote a note on the agreement that we were to point out the water sources before work could start but one of the planned charges was right on a watering trough.

We have several springs developed and we fear something will happen to one of them.

Our lawyer is looking over all the paperwork.

I smell a rat here. It just doesn't sound right . I hope they are the scammers I think they are and you guys get back to every day life soon. 

Micky Shank is basically correct ... well, not about the shotgun stuff, but you should certainly document all discussions and dates of any contact with these guys.  They can not force you to allow the testing unless it is specifically in your contract.  Lies, threats, fraud and coercion have no place in decent business practices.

Collect your documentation of contact and send copies to your Ohio State representatives and copies to the Ohio AG.  Include a good description of what has taken place.

This is exactly the type of crappy business practice that CHK is known for and from what I understand, TGS is working for CHK so CHK is actually responsible for the actions of TGS.

TGS is associated with AEU .  The gal showed me the paperwork.

Who is AEU?  The TGS guy that visited me said he was representing CHK:

American energy Utica ( Aubrey)  ,  maybe both are working with TGS or someone's lying.

How about this. I will tell them that we will sign it if allowed to add a statement that "we are signing under duress". Because that is exactly what is happening. We have been threatened with court action and will be forced.

Here is something I missed , might mean nothing but , If they ARE working with the company you leased with , why would there be a need for another lease/contract , if " exploration " is already noted in your original O&G lease ?  Still seems fishy and I wouldn't sign anything until you get notice from your lease holder and / or your legal advisor . 

That's what I think Mickey,  why are they offering $ 5 an acre ,  they wouldn't have to . We shall see. 

Probably had the same guy come around here last spring. I can't remember his name but it's been a while since I talked to a BSer of that magnitude.

Originally an absentee neighbor called me asking about a letter she got from these TGS people. I immediately called my niece who used to work on a seismic crew out west. She advised me against signing anything and gave several reasons. #1, I should check my lease because allowing a third party to do this without the consent of the lease holder might be a violation of the terms. #2, they're going to pay you $5 an acre, but when they sell the info they gather to the O&G people, they're goung to get a whole lot more. She said said closer $4000 an acre, but I can't verify that. And they'll crap up your land in the process.

The next day I called Bill Ferguson, Guernsey Co. Law Director. Before I could even tell him the whole story he said we didn't have to sign anything unless it was from the company holding our miner rights.

Well, the guy showed up here the very next day before I could call the absentee neighbor. I was locked and loaded already, so I asked a whole bunch of questions. He ended up telling me about how he and Aubrey go way back, and Aubrey this, and Aubrey that. I said - well you have Aubrey call me and we'll talk. Haven't seen the guy since.

Next day I spoke to another neighbor farther up the road. He got an entirely different story from this same character. And yeah, the guy tried to strong-arm him by saying they had the right to do this. Then why do they need us to sign anything?

I called around and no one else even saw the guy so as far as I know that neighbor and I are the only people he actually talked to. He did call me about six weeks later saying he had "that information you asked for." I never asked him for any information.

So I hope no one has signed thinking this guy has anything going for him but a good old boy line of BS.

I was about to sign last week but changed my mind. They will probably have to force me ,which doesn't bother me a bit.
