Forced pooling and a production unit are two seperate issues. As it is written, forced pooling amounts to a legal "land/rights" grab.
But forced pooling isn't the only problem WV has with drilling for the Marcellus Shale Play - the house of delegates felt the need to give the O&G Companies tax incentives to drill here - before they brought regulatory legislation to the industry - giving the O&G Companies even more billions of revenue that should be going to the state to repair our roads, schools and infra-structure - that has already been destroyed by the coal industry (at tax payers expense).
Now "Big Coal" is done and out the door - while WV is dealing with crumbling roads, mine water run-off, mountain top reclaimation and abject poverty of the ghost town communities left in the wake of the coal boom.
Those who forget the past, are doomed to repeat it - we don't want to see the same kind of "pillage" of our state, that we did with the coal industry.
Forced pooling, Mr. Rockefeller, is only one critical aspect of the issues we need to address in the Marcellus Shale Play industry.
And for the record - I am a mineral rights/land owner who supports horisontal drilling - and am eager for these issues to be resolved, so I can collect my royalties. I just want it done in a responsible, regulated, and fiscally beneficial way for WV and her citizens.

Everyone should recall that it was AFTER A "CLOSED DOOR" SESSION in SEN. JEFF KESSLER'S OFFICE, that FORCED POOLING was re-introduced into the "pipeline" - after it had been DEFEATED in the Senate.
Power and money so frequently corrupt those who have it - let's keep close track of those two factions, as the Marcellus Shale legislation progresses.

We will be corresponding with the committee members you have so helpfully listed for us, just to remind them that my mother and I have not changed our position about forced pooling, the regulatory issues and the monitoring and enforcement of the legislation and laws we need to protect all of the rights of the citizens and environment of WV.

Hopefully, like you, others will understand the ramifications that "Forced Pooling" would have on the regulatory issues if it were to be enacted.
