Wrong again.  You are either a landowner who has no idea how pooling works, or you are a small mineral owner who is greedy and think you can make more money by being a hold out til the last minute, against the folks who actually do the drilling.  So, which is it?

Mr. Rockefeller, you need to check your information.

Forced pooling and a production unit are two seperate issues.  As it is written, forced pooling amounts to a legal "land/rights" grab.

But forced pooling isn't the only problem WV has with drilling for the Marcellus Shale Play - the house of delegates felt the need to give the O&G Companies tax incentives to drill here - before they brought regulatory legislation to the industry - giving the O&G Companies even more billions of revenue that should be going to the state to repair our roads, schools and infra-structure - that has already been destroyed by the coal industry (at tax payers expense).

Now "Big Coal" is done and out the door - while WV is dealing with crumbling roads, mine water run-off, mountain top reclaimation and abject poverty of the ghost town communities left in the wake of the coal boom.

Those who forget the past, are doomed to repeat it - we don't want to see the same kind of "pillage" of our state, that we did with the coal industry.

Forced pooling, Mr. Rockefeller, is only one critical aspect of the issues we need to address in the Marcellus Shale Play industry.

And for the record - I am a mineral rights/land owner who supports horisontal drilling - and am eager for these issues to be resolved, so I can collect my royalties.  I just want it done in a responsible, regulated, and fiscally beneficial way for WV and her citizens.

Just a reminder as to what the study committee needs to know !
As Kessler stated "there was a lot of moneyed interest in getting that forced pooling in there."
Will the Oil & Gas companies "moneyed interest" sway the study committee or will West Virginia Mineral Owners fight for their rights and let the Legislators know why they are in office !

1- At least ninety percent of the forced pooling problem is company to company. I challenge anyone to prove that more than two percent of mineral owners in West Virgina have no intentions of ever signing a lease for their oil & gas rights!

2- The companies leasing strategies are proof enough of their underhanded attempt at getting forced pooling!

3- Billions of dollars will be lost to the State and the mineral owners during the coming years of leasing and drilling.

4- The companies will be able to “Hold By Production” millions of acres by including only a portion of large and small parcels in a drilling unit.

5- The companies have taken advantage of many unknowing mineral owners by getting them to sign over multiple parcels within the same county on a single lease, allowing the companies to ''Hold By Production'' all parcels that have been included in the lease, once a well is drilled on any one parcel.

6- You will lose your right to lease your minerals on your terms. All “tax paying” mineral owners in West Virginia should reserve the ''Right to a Fair Lease'' !

7- The companies will be able to take all gas producing formations from the mineral owners. Mineral owners should reserve the right to lease each formation separately.

8- The companies will be able to drill based on all the poorly executed early leases and the forced mineral owners will not be able to add in addendums for protections.
I also believe it to be in our best interest to let the "Joint Interim Committee on Economic Development" members know we are aware of "SENATE CONCURRENT RESOLUTION NO. 62"

Don't think for a second that the Oil & Gas companies are going to let up on getting forced pooling enacted !!!

Thanks, again, Gasoholic, for staying on top of the legislative process regarding WV's Marcellus Shale issues.  Everyone should recall that it was AFTER A "CLOSED DOOR" SESSION in SEN. JEFF KESSLER'S OFFICE, that FORCED POOLING was re-introduced into the "pipeline" - after it had been DEFEATED in the Senate.

Power and money so frequently corrupt those who have it - let's keep close track of those two factions, as the Marcellus Shale legislation progresses.

WV State regulators craft new set of drilling rules
CHARLESTON, W.Va.-- West Virginia environmental regulators want lawmakers to focus on well sites, water management and permit fees as they consider rules for Marcellus Shale natural gas drilling, a spokeswoman said Tuesday.
The Department of Environmental Protection is drafting legislation covering those bases, paring down what it presented for this year's regular session, spokeswoman Kathy Cosco said. Out is language addressing such topics as forced pooling, which involves drilling in areas with multiple mineral rights owners, and the rights of surface owners, she said.
