I'm new to "gomarcellusshale", as well as new to this business.  We have a 152 acre farm with "Clinton" gas wells which supply our needs.

We've been approached by Fossil Creek Energy Corp (FCEC) for $50/acre, 12.5% Royalty, and $10,000 if a well is drilled.  We are sitting on the Utica Strata.  I've carefully read the lease and am very suspicious of the terms.  We are consulting attorneys.  I don't see any members from Noble County..and some interesting notes from Guernsey which lead me to suspect the FCEC lease.  Can they broker a lease after signing "cheap"?

We have news of ARTEX Oil offering leases in our County, they're out of Marietta.  Any comment on FCEC, ARTEX, and my suspicions would be welcomed!

Robert, I don't know. I've been out of state for a while as my daughter had a baby. She and her husband are Navy and he was sent on deployment just before the baby was born. I haven't had a chance to check with anyone.

 

We're in Enoch township over near Fulda. It doesn't seem like anyone here on the forum is in the same area.

 

Some of our neighbors have existing wells and probably leases with gas companies for years now. I don't know what that means. We have a well, but there isn't a lease on it. The previous owners reclaimed the well because the company wasn't paying them anything. My assumption is the mineral rights are intact. We've owned the land about 12 years now.

 

When I called KWGD, they told me that the gas companies negotiate amongst themselves. So even if my neighbors are already with different companies, all is not lost. I'm still really confused about all this though. If people have leases already, do they lose out on the Utica?

Thanks for your help Jon! By "landlocked" I meant we have only one way in. When we had loggers out here, our neighbors on two sides refused to allow access even if they paid, so the loggers had to come up our very narrow, steep township road. They also widened the turn at the top.

 

Because of this experience my husband thought maybe they wouldn't be interested in our acreage. What you say is encouraging. Thanks!

If your neighbors are leased with someone else, that probably won't be a problem in the end. What I have learned is that the actual producing companies like Chesapeake have a way ($$) of getting the leases from other companies so they can have the acreage they need. they will also build and improve roads to get where they want. The townships must love the way they improve the roads with their(CHK) equipment and their $$.

Being "Landlocked" is a surface issue and if you have one way in .. then your not landlocked. The oil & gas issue is subsurface and it makes no difference if you have a way in or out on the surface. They want to lease your oil & gas and can get to it from over a mile away .. underground. Like Jon says .. in the end it will make no difference who your neighbors lease with . .. the producers who wind up with the leases will trade until each gets what they want.  BTW I'm in Guersney Co

Sorry didn't make it on here till just now.  I would say that Jon hit the nail pretty square with these answers though.  And as far as the landlocked issue... that is one of the nice things about being in a group.  When the group decides to take a deal, it includes everybody in the group (for the initial signing anyways).  So everybody will at least get the upfront signing bonus as long as they have clear title & own their mineral rights.  If you are truly "landlocked"  & the people around you are unable or unwilling to obtain a lease, then you may not be able to be included in a drilling unit, hence you may miss out on the royalty opportunities.  But things can change over time & just because someone is unable or unwilling to lease right now, does not mean that they couldn't or wouldn't later.  I believe it is all a gamble, you just have to do what you feel is right for you.

Kevin, Are you joking with us? Where in Noble County are they located? What township? And which company made that offer?
