Silly Question

My ex and I were discussing the fact that the landman also acted as the notary. I say that it is a conflict of interest since the landman benefits (either through commission or direct salary) by getting me to sign a lease....it's his job to get me to sign. My ex doesn't see that as a conflict of interest at all. What do you all think? Not important, but the kind of thing that comes up on a rainy day.

maybe they will green light it sooner,they seem to really want your lease.

The woman at the bank said it usually takes a lot less than 90 days. My deed is pretty straight-forward with one old gas lease and the release from it right in the deed book, so it should go quickly.

I took it in this morning before the dog could eat it or something. The bank has the whole system set up already; many, many people in this area have leased and gotten drafts, so it's routine to them. It took 5 minutes. They are going to put the money in my checking account then have me come in and discuss their wonderful investment plans.

The 90 days period allows Shell to do the title work to let them make sure you actually own your mineral rights.

Another update; the landman came by today with an amended addendum. The contract was all signed and notarized on Saturday, then, today, Shell rewrote the addenda. They rewrote the non-surface addenda to say that they can do the seismic survey. I'm OK with that change, but can they just rewrite the addenda to a contract after I signed it?? I didn't need to sign off on or even initial the change. I'm wondering what else in the contract they can change without me knowing about it. Paranoid? Yeah, maybe. This contract is significant to me; it affects the biggest, most valuable asset I own.

That does not sound right. Were you asked to sign again or was the document changed after it was signed by you? If it was changed after you signed it that is a big no-no.

It was changed after I signed it. I asked the landman if I needed to initial the change, and he said no. He just came by to drop off a copy with the change. Everything is so legal and binding on my end, but the gas company seems to be able to do whatever they want.  I wonder if they can file a completely different addendum than I agreed to?

It's my understanding that Shell lease's and others i've seen allow for seismic testing if needed,so since you have a no surface lease they wanted to make sure  necessary testing could be done if needed,they probably won't make that oversight again.Thats my view of it I wouldn't loose any sleep over it.
