Anyone know what  the most recent  signing terms are for with CHK in Tusc?

I am still wating for a meeting with the ALOV group out of Leetonia, OH. Has anyone heard anything from them in March of 2012, or does anyone have a better group to contact. I have a small 3.5 acres on the south side of New Philadelphia in Goshen Township near a large tract of property that was signed last year. Any and all information would be greatly welcomed. Thanks in advance  Gary Harrington

i signed my lease with chk and im in goshen as well and waited 110 days and the week i was supposed to get my check they sent me a letter telling me that after a title research the followin parcel is being held by production therfore null and void. what the heck is that supposed to mean. nothing like making me wait till the last minute to tell me such wonderful news. they made it sound like such a for sure thing when we signed with them.

We have found out that most of Tusc Co is held by production, and we found ourselves in the exact same position you're in.  To top it off, the clinton well company we thought had us HBP, actually didn't even own the deep drill rights to our land--turns out our deep drilling rights were sold to CONSOL years ago!  The clinton company didn't even know what they owned until they brought in a consultant in to tell them what drilling formations they actually owned.

This whole adventure started for us back in May/June, and we finally know where we stand, 10 months later.  A title search should tell you who is holding you HBP.  Once you have a name, call them and they can tell you exactly who you're already leased by. Or, you could call the County Recorder's office and hopefully they can give you some info.  But, the "quiet" leasing activity in Tusc seems to be because we've all been leased for a very long time. You're probably already in business with someone, you just don't know with who yet.

I found that same information out on some acres.

 

Some HBP owns all rights....they are dealing with someone to stike a deal to drill deep rights,  they may need you to sign an addendum to change old lease terms (pooling...)

 

Some HBP don't own deep rights....I think Enervest has mine.   In this case......why would the deep rights still be considered HBP?  It seems the lease was separated into deep/shallow formations.  If so....wouldn't the deep rights be expired due to no drilling?

I had our attorney look over the lease transfers, etc. and he seems to think all original lease terms/royalties apply to the core of the earth, even though the original owner of all formations separated the clinton/sands formation and sold those to Randell Oil.

The original driller retained the "deep drilling" rights, which were then sold to CONSOL.  What we think is happening now, is a back-room deal between Randell and CONSOL, as Randell can hold their clinton formation "hostage" and not allow CONSOL to drill through it without being bought out or highly compensated.  Once again, we get nada.

We are limited by a 160 acre unit, but so far that's our only clause that could open talks for a more landowner-friendly lease addendum down the road.  Since June, we've paid for 2 title searches, an O&G atty to review and advise, and countless phone calls to Randell trying to get answers!  Turns out too, the owners of our land (from two owners ago) had been collecting our royalties for 5 1/2 years to boot!  

I'm just glad we own our mineral rights. That is one thing we know for sure. We bought the land for sentimental reasons, and this is all a big hassle, but potentially the best investment we ever made.  Time will tell.

So does that mean somebody already has the mineral rights to my property and it's already leased by another company.

It would appear that way Chris. did you look up your property before even signing the lease?

no i didnt they just came over talked to me about it and i signed the lease. then she called me back and said that it looks like i have the mineral rights then the week that i was supposed to get my check i got a paper in the mail stating that they were being held by production.

Well if that be the case if your held by production there must be a lease on the property. I would visit the county recorders office, I would also check to see if you had a title search ran on your property  when you purchased it and what that search stated.
