But in that situation, isn't it usually the top lease that's surrendered? For the 9/4 surrenders, if you put the mouse pointer over the Instrument #, the pop-up box shows the referenced lease memo is from 2009. (The first 4 digits is the year.)

OK, so what does all of this mean? Not trying to read too much into things. Also, our lease was signed in June of 2012.
Hi Preston. I can't help too much regarding surrenders. But as far as the well status goes - Shell never did revise the unit map to include your property, so that information you received about the Fish unit was apparently in error. The well went into production in March - before you were signed - and we have been receiving royalty checks for a few months now. I don't know if that initial error about the unit is why they surrendered the lease - because it's not longer needed - or not. If it was me, I'd probably want to try to talk to someone at Shell/SWEPI. As I recall, there was a hotline number published awhile back and whoever answers that phone should be able to direct you to the right person; either in Warrendale or in Texas someplace.
Took the release documents to lawyer today. First time I had seen the letter-only about 5 sentences long 1 paragraph. States basically that Shell is no longer authorized to take leases, remember I am doing this from memory. As I live in Central PA, and go up to take care of yard and such at Dads house. Left the paperwork there. It was basically a voiding of the lease, no we did not receive any bonus payments yet. I thought it was done strangely.
Preston what's so strange with your parcels is Shell had you HBP'ed under the original Fish unit at 426 acres with your Phillips lease, then they amended the unit to 304 acres with you out,Only to lease you again, then surrender.Wonder whats next for you.Good luck dealing with the insane.
To clarify those surrenders are for top leases. In 08-09 East signed many top lease options (re) Root top lease
group.Those top leases were for properties with original leases to ex. in 2010-2011. East/Shell has HBP'ed under the original lease. Top lease no longer needed. It can take Shell up to a year before they get around to file the surrender.
This is in reference to the multitude of surrenders, not specifically to the Preston's lease. hope this helps clarify.

Yes, still leased. HBP'ed under original lease which had not expired. In 08-09 East was not sure they were going to get there leases which were set to expire in 2010-2012 drilled=HBP'ed in time so they offered to sign top leases, i can't remember the exact #'s, i'm thinking $150.00 at signing and $1500.00 at time top lease was to kick in. Those top leases were recorded as a memoradum showing a lease date of 08-09, but the unrecorded lease explained the lease was to take effect at the expiration date of the original lease.That is why the surrender refers to lease DATED 08 or 09 for example.
Still think it is interesting that on July 11th and 20th there were at least 17 leases released that were signed in 2012. Ours was released on July 27th. None of these were signed in 08-09.
They all were signed in 2008 and 09 look at the docs all have original recording dates of 08-09 , original Instrument #s start with 2008-2009.
Interesting-of all the Richmond twp that were dropped, we were the only new one! We are gas central where the homestead is with wells in the back yard, pond over the hill, road for the pond, pipelines, and neighbors moved out-all of this and we won't benefit, only have the down side. Oh well.
