It is OK Mr. Moldyoak ,

Discussion is what we need about this industry and how it  effects our Communities, there are many other sites.   There must be a site that is not worried about advertisers and pleasing them. 

It is his site to do as he pleases I respect that; if all positive in the Gas Industry is what he wants on this site I gotta say see ya later Guys. People that get offended by people telling their stories or asking questions only to be blocked have another goal or Gain!   The way I see that is a one individual  place that does not want more Balance~

You wonder why all our Politicians cannot get along NO BODY compromises!  Go Pennsylvania!  

I have been following this site for years and it has been very interesting, until now. The garbage that has been coming out of certain peoples mouths is getting too overbearing. You should switch to Facebook, a place you can talk all about yourself and downgrading of people you see fit all you want. Keith is doing an outstanding job with all states and counties ect.that he posts info about. Its not a site to talk bs in. I wish he could delete a lot more crap. can any one tell me if no more than 1.00 per mmbtu is a fair cost for deductions. The land man said its more like 50 cents per mmbtu that is taken out ??

I guess what is "fair" is subjective and depends on your lease language. I have the Market Enhancement clause in my lease, so its better than the old boilerplate leases but still more deductions than I really like. Over the last 14 months of production, CHK deductions ranged from 69 cents up to $1.28 per MCF with the average at 88.5 cents. The dollar plus months were when they charged big for transportation. Anadarko was much more consistent, ranged from 74 cents to 78 cents

How are you guys paying a deduction that is higher on a percentage basis than your royalty?  In other words, if your royalty is 15% how on earth did the deductions not get capped at 15% of your share of the enhancement cost? 

I'm not a lawyer or an accountant, and not sure I really understand your assumption that the royalty % would also act as a cap on deductions as a % of royalty payments or enhancement costs, but I'll take a stab at it. Anadarko is the easiest to follow as they report the deductions on their share of the full unit production as well as the total sale value. CHK only shows the deduction amounts on the "Owner Share" portion of the statement. I get "charged" for each of the deduction categories by the same "Owner Decimal Interest" factor as is used to calculate my share of the gross income. So, they are using the same % as my royalty on the deductions. So, at least in a sense the deductions are capped but there is no independent language in my lease to control the % or amount of deductions compared to the sales price. This is what has led to the various legal actions and disputes with the gas companies here in PA.

Should have used a lawyer.  Even some of the most basic boilerplate leases here in Ohio capped deductions at 10% of the total royalty paid, meaning that on a 12.5% LOR the landowner would never be charged an amount above 1.25% of their royalty. 

I did, seems like Ohio had better protections than PA. Back when I leased, the market enhancement language was thought to be good protection compared to the standard lease language which put NO limitations on deductions besides the statutory 12.5% minimum royalty which the Kilmer decision pretty much made a joke.

If I were you I wouldn't use that lawyer anymore. Sorry about your situation.
