Feel like I have been left in the dark! Does any one  know anything about Aubrey and any drilling? I NEVER hear about any activity concerning his company(AEP). I first signed on with Shell, then Shell sold out to AEP and that has been that. Does anyone else, that has their lease through AEP, know ANYTHING about what is going on and when there might be some drilling starting?

The other companies are so much ahead of AEP! You are always hearing about this well and that well or company but never anything about Aubrey's AEP company doing anything. Am I the only one hooked up with AEP? I never see anyone else asking questions about AEP). ---------Fell like the lone ranger!

Thanks for any info you might have.

Again, before you get a lawyer, find out if you have a well on your property.  Then look at the old well cards for that well and determine whether or not it is cost effective to hire a lawyer.  Here is a screen capture of the ODNR Gas well viewer for the area around your land.  Do you see a well on your property?

Ok, looking over everything I'd say you are most definitely tied into a unit.  The K&R Conservation lease is probably all being held by those multiple units.  Did Shell pay you without any reservations the first time around?

"They legally cannot cash in on any oil/gas royalties, can they, since we own the mineral rights?"

No, but good luck collecting anything.  If they were paid in error all of those years then your recovered damages ought to just about cover your legal fees.

When your dads mineral rights transfered to you, you needed to contact the company that had the lease on the property and provide them with a copy of the transfer so they would know who to send the royalty payments to.  This money may be setting in escrow account some where just waiting to be collected.  Good luck and get an attorney.

Sam,

What company are you referring to,  K & R Conservations, LLC? The current land owner/s.

Thanks for the input!

These wells were drilled long after your father sold the land and kept the minerals.  They were drilled in the mid 1980's.  It's pretty obvious what happened.  K&R leased the land, the wells were drilled without issue because no one bothered to run title.  Now you have a mess and a half on your hands.  Call an attorney right now.  You can call the guy at KWGD, they're competent.  Expensive, but competent.

Phillip and Dexter

Well # 2 and well #4 are both in section 21, which on our quit Claim Deed it states, our tract of land is located in section 21. Both of the wells are still producing and has been since 1985-today.

No, we had no problems with Shell at the lease signing. They gave us $5,000 and acre and 20% on the royalties)gas/oil). the signing bonus was quite nice.

Why didn't they do a title search, like Shell did and find that David Z. Winn Sr., my father, owned the mineral rights? Just wondering.

Sam just wrote and suggested the royalties are perhaps in a escrow account. Where would we start to look for that and would you suggest we contact K & R Conservation LLC about our father's, now mine and my brothers royalties  and where they are., now ?

You all have been so helpful and I appreciate what you are doing for me by sharing your knowledge about this. I really am not informed at all about this oil/gas "stuff. I just signed on the bottom line!

Have learned, now, from you all, how to use the ODNR map. Didn't know what it was till you all helped me with it! Thanks!

Odds are that there are no producing wells on the property that you received from your dad.  If there where you would not have received a sign on bonus and would only receive 12.5% royalty on any deep wells drilled.  The old wells only tied up 20 to 40 acres.

1967 plat map for section 21

Section 21 is 640 acres, more or less. You mentioned 79 acres. Which quarter section of section 21 was your 79 acres located in?

Finnbear,

property , which we just own the mineral rights to, borders Harrison County on the north and is the third(3rd) acreage in from the west border of section 21.

Parcel # 20-00301---- So I would say located -------north central in section 21.

There are 4 properties on the north edge of section 21(on the border of Harrison County). Mine is the third (3rd) property in from the west side border of section 21.

My mother and father's name(David and Virginia Winn)) is on the map above this post (posted by Phillip Brutz) showing where the mineral rights are.

nc man,

AEU/AEP has the following permits to date;

Harrison county = 28 permits (5 locations)

Guernsey county = 13 permits (6 locations - 3 in your twp)

Belmont county = 6 permits (2 locations)

not sure how many rigs they are drilling with - but they are drilling in all 3 counties.........I would say at least 5 rigs maybe 7 or 8.

the viewer shows 1 in production (jones well in Harrison) but no production numbers from odnr yet.....maybe on Q2 report.

agree with dexter they will be drilling like gangbusters soon.........I read somewhere that they will be renting 11 rigs from CHK.

you will soon be hearing more about AEU.
