David,

It all depends on your lease. In order for the deep rights to be released from your lease, where the shallow rights are producing, there must be a vertical pugh clause in your lease.

When was the lease signed?  Are you receiving royalties from any existing shallow wells on the property?

Signed September 2009. No royalties, just free gas

That doesn't sound right David.  In PA there is a mandatory 12.5% royalty payment.
