According to DEP webiste, there were two marcellus wells permitted and drilled in Forest County in 2010.

Thanks for your reply.  I have a little over a hundred acres near Whig Hill.  According to the DEP, there is an active well near the State Police barracks on Hwy. 36.  There is talk of more wells on the same pad. 

 

Do you have any knowledge or experience as to whether recent sales of mineral rights for the 1,500 foot wells include language wherein there is also a sale of deep mineral rights?  Catalyst has purchased a lot of sub-surface mineral rights in our area ~ however, I have not seen their contracts.  Such provisions could be easily added (?) and have profound impact on the landowners.

As I am sure you are aware there is still a significant amount of shallow oil & gas drilling going on in Forest County. DEP issued 489 non-marcellus convential permits in 2009 in Forest County and another 287 in 2010.  Catalyst is not on DEP's Acitve Marcellus Producers list and my experience with them is that they are mostly active in non-marcellus. 

 

Most of the recent leases I have seen in Northwestern Pa, initially being offered from companies seeking to produce from other formations and not seeking to procuce from the Marcellus still did NOT include a provision that excluded out the production from the Marcellus.  Obviously everyones situation and circumstatnces are different and if the leases are recent and were reviewed by an exerienced O&G attorney there is a chance that some of the leases may have excluded out the Marcellus and other non-conventional shale formations.
