The SURE lease states that CHK is responsible for paying the Ad Valorum Tax bill that was recently received. What steps are you taking to make sure that CHK pays the bill?  I was told by the Carroll County Treasurers office that they could not bill Chesapeake directly. Has anyone contacted CHK about this?  Planning to send a letter with a copy of the lease and the bill to CHK via registered mail unless someone has a better idea? Thanks for your input!

AJ,

Bruce Buck called the Ohio Tax Commissioners Office and was told that in 2017 the County Tax Bills will be sent directly to Chesapeake.

The evidence is on  my tax bill, it shows the following: (Chesapeake Energy) below the bill.

Call the County or the Joe Testa while he is still in office, and ask them this question.

Please let us know what they tell you.

If you know Bruce, you can take what he says to the Bank.

Those who have land under CAUV and can't explain why your taxes are going up, see the lawsuit against our current governor and tax commissioner written by Kevin T Roberts.

The White House wannabe worked with the tax commissioner to shift taxes from Ohio Income Taxes to Real Estate Taxes.

Also do a search on the Ohio Farmers Union who have recognized this CAUV tax increase doesn't follow the law for determining CAUV Tax.

This will be a Class Action Suit with the money recovered being shared with each Ohio Landowner under the CAUV based on their percent of land under CAUV.

This Shifting of the tax burden was the key to our losers attempt at the White House. Keeping the multi Billion Dollar Theft of Ohio's NGLs and severe underpayment of royalties was also important.

The word is getting out, and Ohio Citizens will be very unhappy that those in charge would allow these Sins to be committed against the Citizens of Ohio.

Thanks for the heads up Ron.

J-O,

    You're welcome.

Cheryl,

Wondering if your lease were specific to sending CHK the bill ?

If it were, would they (the taxing entities) then be able to send CHK the bill ? ?

Anybody carrying such a stipulation in their lease ALOV / SURE or other ?

These questions are basically the same as that which you pose (and seems to me it's a damn shame that most of the time what seems to be plain english becomes weaseled) but, since the whole leasing thing seems to me to hinge on specific articulation I thought to put it in these terms.

J-O,

All ALOV and SURE leases have the same statement about the Producer paying any taxing entity that comes up with an increase in taxes or a new tax related to Oil & Gas production or structures placed on a landowners parcel.

Since this lease was won in an auction by Chesapeake (Aubrey McClendon?????) I don't think the name of the producer was included in the lease paragraph.

I would think the Williams Leases had the same statement since the ALOV & SURE leases were written with the Williams Lease as the starting point, based on info from the past either written or stated.

Take a look at the SURE Lease on alov.us, it's on the bottom of the 1st Page listed as "SURE March 2012".

J-O, if you ask one or two questions at a time you would get a better response from everyone.
