What is the amount of land a gas well affects for Clean and Green roll back in taxes?

My Uncle has land in Bradford County and it is currently in Clean and Green.  If he gets a well does his whole property get rolled back seven years for Clean and Green taxes or only the pad size of say 5 acres?

I believe the counties are waiting for the state legislature to rule on that. In Susquehanna County, the commissioners tried to roll back the entire acreage, but backed off. The penalty is significant since it is 6% for the first year, 12% for the second....36% for the sixth!
As I understand it, counties use different approaches. Some take the reasonable approach that if the pad is six acres, six acres of taxes for seven years must be paid. Bradford, and several others have taken the absurd position that if you have 1000 acres, and place a six acre pad anywhere on it, the taxes are due for seven years on all 1000 acres! Yet you can subdivied and sell a parcel, and only the taxes on that parecl are due. I think there will be a lot of money going back to land owners if Harrisburg ever gets around to this...
As it stands now in Bradford County, the whole property is subject to roll back taxes when the well goes into production. Which means you pay the roll back on all of the property but then you can reapply for the remainder of the land (minus the well pad) for Clean and Green. My suggestion is that you either make sure that the gas company has to pay for these expenses, via the lease agreement. If you have not done that remember if you pay the roll back and the state amends the Clean and Green law as proposed you will not get the taxes you paid returned to you. Also be aware that if the company pays the taxes they may have the right (under your lease) to deduct these expenses from your royalty checks.
