Has anyone else been approached by EQT Gathering in reference to obtaining a pipeline right of way?

Red-Our contract says the same thing about the timber-we probably have the same lopsided contract pricing and terms. By the way if you look at the "Addendum to Damage Release" page of your contract in the upper left corner it reads "Project:" Ours says "Viper"

That is the name of the pipeline project.

By the way, I redid the math on ours, and realized the $9.19/lf also includes reimbursement for damages. But like I said, we gave our contract to an attorney. We are going to try to negotiate the payment, the lawyer is going to make changes to the language in the contract.

 

Gerald-"Forever" is a big reason I hesitate to sign the contract with its current pricing and terms. Forever, and everything that goes with forever, the disruption and intrusion, and one meager payoff! I suppose I would look at this alot more positively if the oil/gas company that leased our land was proposing a pipeline like Scott's situation.

True enough, but I view the O & G lease and the pipeline as completely seperate issues.  There is an incomprehensible amount of money in this stuff at all levels.  When there is only a one time payment and no ongoing revenue stream (from this agreement,) you've really got to cover all the bases. 

OOHRAH- I dropped ours off at the attorneys yesterday, when you hear back let me know and I'll do the same. Like everything else if everyone sticks together they won;t have much choice but to be fair with everybody or at least they can be reasonable. One of our neighbors has already flat turned then down, they wanted to go across right behind  her house.

RE: "One thing to remember with ALL right of way easement agreements. THEY ARE FOREVER. Unlike a drilling site or mineral rights leasing that normally have an end time of some sort or another. With a right of way easement once it is signed and in effect, it will effect that property and future owners of the land forever. So be 100% sure that all possible items are taken into consideration. A qualified attorney with experience in easements is imperative in getting a document that protects you, spells out everything, and you can live with."

That statement is worth printing out in bold type, having framed and hung on the kitchen wall.

Landowners,

        When the 36 inch pipelines come through your area you will want to make them pay you for your right of way as well. The collection pipeline companies are effectively stealing your right of way with their contract wording. 

I gave the below paragraph (modified from the alov.us site) to our local collection pipeline company and told them they will need to specify the number, size and contents of each pipe before I will sign it. They are paying for one pipe to pass through the right of way but will not own it to sell to the larger pipelines as their contract implies. Every pipeline company that needs to cross your land should pay you. I believe the below statement will accomplish that.   Make sure your lawyer uses this paragraph, if he doesn't fire him, since he hasn't protected you by maintaining your right of way for your benefit. At least one lawyer I have seen is playing dumb in this area. He is positioned to take the landowners money and money from the pipeline company for allowing them to take what is yours.      "Money Brings Out The Worst In People".

a. Single Pipeline. This Easement allows one pipeline with a maximum diameter of __________________inches, and with the maximum pressure of product transported within the pipeline of _____ pounds per square inch. The pipeline shall be used only for the transportation of ____________________ unless renegotiated with the Lessor/landowner.
