Forced Oil and Gas Unitization

Does anyone have any info or help in dealing with the Forced Unitization? Found out from atty in Columbus that Gulfport has filed one which includes our land. Gulfport has never even talked to us about leasing our minerals.

The state will notify you if such an action has been taken.

One of the criteria a company must meet is proof that it has attempted to lease your property in good faith.

Sounds as though it won't meet that criteria.

How did your attorney come by this information?

You may want to contact the ODNR and ask if your property is part of a permit application.

Thanks for your info. I did contact ODNR Fri, the local guy didn't have any info but forwarded my info to ODNR atty in Columbus. Also called a guy at ODNR that is in utilization and left msg. He won't be back in til tomorrow. Talked to a girl in New Phili office but she couldn't look up anything that had been filed. They update their files at end of week. I'm just amazed that they would file without ever trying to buy them. It's not like we have a couple acres. We have 800

Are you positive that you own the mineral rights? I'm sure you do but it sounds like you don't for some reason

If they weren't my minerals why would they file this? They would already own them.

Are they trying to force pool all 800 acres?  Is this old reclaimed strip mines, that a coal company may own the rights?  Id be on the phone with what ever landman is in charge of the unit at the Oklahoma city office.

Are you leased with another gas company?  Raven Rocks is the only other landowner in Wayne twp. that I know of with that much unleased property.

Michele it looks like you are leased with Oxford Oil-Eclipse.  Eclipse must not want to partner with Gulfport.

Could forced pooling be used to get around the pooling size restrictions of old Oxford leases?  If Gulfport  force pools Eclipse then Eclipse has the option to partner in the well without getting a lease addendum from the landowner.

No, the terms of the original lease apply. The land owner could use unit size stated in the lease as a reason for the application to be denied .

This is my opinion and interpretation of course.
