One of the criteria a company must meet is proof that it has attempted to lease your property in good faith.
Sounds as though it won't meet that criteria.
How did your attorney come by this information?
You may want to contact the ODNR and ask if your property is part of a permit application.

Permalink Reply by Philip Brutz on November 13, 2013 at 1:21am Could forced pooling be used to get around the pooling size restrictions of old Oxford leases? If Gulfport force pools Eclipse then Eclipse has the option to partner in the well without getting a lease addendum from the landowner.

No, the terms of the original lease apply. The land owner could use unit size stated in the lease as a reason for the application to be denied .
This is my opinion and interpretation of course.
