WEST VIRGINIA FORCED POOLING BILL MOVED TO ENERGY, INDUSTRY AND MINING SUBCOMMITTEE

BEFORE THE ADJOURNMENT OF TODAY'S MEETING OF THE WEST VIRGINIA SENATE'S ENERGY, INDUSTRY AND MINING COMMITTEE MEETING, IT WAS DECIDED TO MOVE THE PROPOSED MARCELLUS BILL WITH ITS FORCED POOLING PROVISON ON TO A THREE (3) MEMBER SUBCOMMITTEE FOR FURTHER REVIEW. THESE ARE THE SENATORS THAT YOU NEED TO CALL, EMAIL OR WRITE TO VOICE YOUR OPPOSITION TO FORCED POOLING.

Thanks, James for your post.  Yes, I believe it would be challenged in court - but in the meantime, if it was passed - there will probably be thousands of acres grabbed and drained before the law can be amended.  Once the gas is gone from your holding, it's gone - and no amount of litigation is going to get it back... and by the time you have paid for that litigation, no amount of restitution will ever be enough to cover your losses.

The O&G companies already have a plan for it....

  Amazing  truly Amazing you would use the term EMINENT DOMAIN! By that standard what right by any standard do you have to try and take a landowners opportunity of wealth away by controlling his land with your anti fracking activities? 

  Looks like eminent domain doesn't exist or home rule when you want to flood a community with multi family residences against a communities desires right? Oh I guess if your the real estate developer its the profit that counts.

  I have a idea for ya get some Wealthy Investors from Dallas to set up a non profit save the earth from fracking 501 (c) (3) and do the following.

  In America the Constitution provides a citizen with property rights. When the government that you want takes away that right by eminent domain then the owner of that property is to be compensated for the loss resulting from that action. So get your check book out and get ready to pay a farmer or landowner $3000 to $10,000 a acre up front money on the lease he cannot utilize times his acreage. Yep write the land owner of a 100 tract a check for $300,000 - $1,000,000 for the lease, pay him $20,000 to $30,000 for the two acres for the drilling pad then pay him the loss upon his royalty of about $86,000 per month not including the gas royalty! 
Now in a free enterprise system in a free country it would seem fare to me. Bank Cashier’s Checks Only Please.
