Well, there are 4 of us left standing on a lease. 3 of our relatives signed a unchanged company lease (ouch).  4 relatives signed a lease that still had language left in it or needed to to be ammended.  The last 4 of us do not want to sign unless the language for our protection is either amended or taken out of the lease.  Are there any laws which can force us into a lease or can we decide on our own to sign or not to sign.  We do not want to have any regrets down the road.  Thanks in advance

When there are many owners, it would appear that the combined majority % of each of your positions would hold up, possibly in court.

I don't see any way other than this as a solution for your situation.

Some of your people signed different documents and then the rest of you didn't.

This seems like a mess.

The mess was created by greed.  In Wv. I do not think they have passed legistlation on force pooling yetttt.  So much for trying to get everyone a fair shake on a lease. I may as well just peed in the wind because most took the money and ran and signed a lease that contained no legal protection at all.

Here's the WV law on units. I just started reading it. Number 7 is very interesting when it says how big a unit can be. An oil well can't be bigger than 160 acres.
I think it was 9 that says no unleased land can be included. I'm not done skimming this yet so it may get to forced pooling.

Every State has its own laws. Your situation is one for which a WV Attorney should advise.

 

I would  suggest that you four holdouts continue to be firm and hold out, pending advice from an Attorney.

You are wise in refusing to sign a contract that you are uncomfortable signing.

I do not believe that it is a valid lease until ALL parties sign; but that is just an opinion from an individual who is unqualified to advise.
