M&P BEING SUED / CLASS-ACTION SUIT AGAINST HALCON, M&P & CX

 

Hello everyone:

                         I have not posted anything on here before. I have always just read the comments of others. I thought I would just post some thoughts. After being patient for 8 1/2 months I still have no answers like others in the south east Mercer County area. Is Halcon going to be held responsible for their actions? Are they going to be made to pay for the contracts they signed for? How qualified is M&P when it comes to representing the landowners of group 4 against a company like Halcon with deep pockets. Will we get an honest effort from M&P or will they make it as short as possible and except less than what we deserve to mitigate damages on their behalf. I have just read, in detail, the civil suit against M&P by Terra Energy LLC. Now it seems to me that the landowners not only have to worry about being pushed around by an unethical oil & gas Co, but now we have to worry about the real motives of the law firm we have to represent us. Are they going to treat clients like they treated business partners? I think if given a chance M&P will come back to the land owners after any legal actions against Halcon with a bogus report how they couldn't do much and if we continue it will tie up our lands for years, of course due to a half hearted attempt at getting us what we legally are owed.

                        I only have this attitude after listening to M&P for 8 1/2 months tell us how important it is to stick together as a group but they will break up the group at the drop of a hat to sign a little chunk to this O&G Co and another chunk to a different O&G Co. This sticking together only benefitted them by having all of us available to them for whatever size of lease they could get from any other O&G Co. After seeing an E-Mail to Terra Energy Advisors LLC from Jack Polochak describing how maybe Terra Energy should  get some leases signed by an O&G Co that are less than desirable for landowners to make it look like A Co he was partnering up with was successful in the oil and gas leasing business. That just shows me that he will sacrifice his clients profits to improve his and his associates. I think everyone should read the Lawsuit especially the landowners of group 4. Maybe I am seeing this in a sinister way and I am just swayed by how the rest of the world does things these days. Here is the link to the Lawsuit. State courts may look to another jurisdiction to see how a particular issue has been addressed (typically to the other state's supreme court), but are not required to follow the decision.  In other words, a decision by a court in Ohio, Texas etc could be viewed/analyzed by a Pa court, but the foreign decision would not be binding precedent. 

If you want to vomit, google CX Energy and pull up their website. I consider CX as being closely connected to M&P. Slick advertising about how they work with attorneys to negotiate premium O&G leases for landowners. You will see that they have upcoming meetings! Beware! Someone named George Brown just gave them an endorsement on the Venango County website. Maybe he is one of their shills. Meanwhile the M&P / CX juggernaut rolls on.?? 

I wish the Pennsylvania Attorney General would start a task force of some kind. There is absolutely no regulation governing how these deals get done. It is like the wild ,wild west...and if you do not own a horse (KNOWLEDGE) or a gun (ATTORNEY)...you are s--t out of luck. So many horror stories the past 4 years...I never thought I would become a victim...but I was WRONG!

George Brown also said CX has map on their website showing all the land CX controls in Venango County. I was unable to find it but I am not very good with computer! There is a list of upcoming meetings and a statement that CX works with attorneys to negotiate premium O&G leases for landowners. The primary attorneys that CX has been associated with...none other than M$P.( If anyone can find the map, please post how I might find it. Maybe its only available to persons after they sign marketing agreements with CX.

CX gives its current members access to the property they are bidding on and then show the map (Google Earth/GIS) to the o and g cos.
I have all my old paperwork - and I read yesterday that the bidder and withdraw offer at any time for any reason. It is written that clearly.

Just to clarify, CX gives you a secure login to view the mapping tool.  You can't get to it until you sign with them. I find the tool very useful even outside of oil and gas.  I used it to find out who owned my neighboring parcels so I could contact them to get their permission to hunt on their property.  I could do the same thing by visiting the courthouse, but that's in Franklin and I live south of Pittsburgh! A few clicks of the mouse beats a round trip to Franklin, especially with today's gas prices.

 

I apologize to Mr. Brown. He is an honorable man and I made a mistake in referring to him as a possible shill for CX Energy. I do not apologize for any comments I have made about CX Energy who I believe is as responsible as M&P for the debacle that occurred in Mercer County. Indeed a lot of the meetings were M&P / CX joint meetings. Representatives of both entities repeatedly told landowners that if a landowner had no defects in his title, that landowner would be paid bonus money by Halcon!

Right on Samuel.  A simple search on here proves what CX was doing and saying back then.  Anyone that signs with them in Venango is off their rocker. 

Mike C. Could you post your comment to the Venango County site? I sometimes think people pay attention only to their own county and do not read the important general discussion threads. This discussion is surely one of the most important to appear in some time. Maybe a post encouraging them to read this entire thread. With entities like M&P and CX Energy, an ounce of prevention may be worth many pounds of cure. My invitation for warning posts to the Venango County sites extends to all viewing this post!

I have read their agreement and yes, they are slick and the fine print within the agreement was enough to scare me off....but if you ask Janice Hancharick and her associates they are "the cream that is rising to the top".  I am sorry, but I can't get that darn phrase out of my head and it gives me indigestion (burp...sorry, that one's on me) every time it's mentioned .  I couldn't help but notice certain CX faithful have gone silent...would love to hear their input here.

If you want to be amused about what appears to be a new fraud in perpetration go to general Discussions and read the thread inquiring about DUX Petroleum LLC! This is apparently occurring in Washington County, Pa. It's a short thread but makes good reading!
