Chuck, thanks for all the good information. You've contributed a lot to this forum. It seems like everyone has a little bit of informatino from their own circumstance, and collectively we all become pretty educated. Thank you for your responses.

Jacqueline, If you look under SURRENDER OF LEASE you will see that after the lease original 5 year term is up and sometime in the future when your leaseing company decides to cancell the lease it says upon surrender the leaseing company has easement rights for all pipelines, electric lines, phone lines, roads, and etc. and the right to enter the erea at any time.

Another thing to note: After the up front payment, (there is no second payment) you are pretty much tied in forever, because as long as you receive some type of payment for anything, no matter how small, the lease stays in effect.

Aaron, we have 74 acres and have been offered $1000.00 per acre so far by DPS for Chesapeake, Caralier is still way below that but will say yes to just about everything you ask for on a lease, which to me is very scary. I think they are a leaseing company for a leaseing company that will then sell to the highest bidder, and some where in the translation all pre-approved terms will be null and void.

I have asked the Leasing Co. to add the following to the addendum, because beyond the original 5 year term, the landowner is at the mercy of the Leaseing Co. This would even up the odds a little.

"At the end of the 5 year primary term, if the lessor is not receiving monetary compensation equal to or above the yearly value of the original up front payment of ($???.00) per acre per year for the full (?? acres) the lessee will pay the lessor the difference on the anniversary date yearly for as long as the lease is in effect, the compensation will also continue if the lease is surrendered and if any easement rights are granted to the lessee for as long as those easement rights are in effect."

Vinchenzo, there is a clause in MY example lease agreement that states if they put pipelines on or across your property from another property they have to pay you a one time 5.00$ a lineal foot "royalty". This clause scares the crap out of me. They can legally run pipelines from another well on someone else's property and this has nothing to do with your lease. this means that even after your lease agreement has expired, these pipelines can stay there until the other lease expires leaving you without legal recourse. I'm currently trying to get that clause removed (not looking good). But they did offer to include a clause that stipulates they bury the pipelines 32" under ground. These pipes are roughly 24" in diameter. I strongly suggest you take the time to read the contract. How much property do you own? Good luck

I was offered 900 plus 13.5% in jefferson county for my property to lease for 5 years. I don't read anything in the contract (I haven't signed yet) about pipeline royalities... Am I missing something? I do not see "pipelines" mentioned anywhere in the contract. Has anyone dealt with this specifically?

Aaron, I do not know of a group in our area but I think it would be good if we could start one. I am new to all of this and really don't know where to start but am willing to help however I can. Let me know what we can do

Jacqueline, it would be great if there were a group of us. Do you know if there is a group out there that exists? If not, I wouldn't be opposed to trying to form one. I know roughly you are, and you should be getting roughly the same offers that I am. If you contact DPS Penn I'm sure they would offer you more than 100/acre. Thanks for the info

Aaron, I do know of a bunch of people in southern Columbianna co. (e. Liverpool, wellsville area) who just signed for 2000 & 15%. That is not very far from our area
