Shell contacted us in April 2012 with an offer to lease our 10 acres in mercer twp for $3200/acre. We hired an attorney, he fine tuned the lease and when we were ready to sign shell said their leasing was on hold. Early Aug. the attorney (whose name im probably not allowed to metion) said shell had resumed leasing and sent us a lease to sign, never pointing out that it was for $2500/acre! We are currently on hold, but don't want to end up with nothing, but also don't want to be played for a sucker. Has anyone else experienced similar situations with an attorney or shell?

I really don't know a whole lot about the land (front end) of things but if I take a stab at trying to understand it, I would GUESS that you feel joining a group of other landowners and trying to get a deal with a company as a group because there is more land in one general location is the same as not signing with a company because you want more money or don't want to sign with company A because you want to sign with company B blah blah blah... am I correct? If so, I can totally see where that could be true. I would think that joining a landowner group would be beneficial only in the support and knowledge that could be gained from within the group. Just because you are signed at the same time (because of said group) doesn't mean that all of the landowners will be put in the same unit or into a unit at all when it comes time for actual work to begin in the area.

 

Of course I'm just an industry bitch that doesn't know anything and I'm only in it for the money. Oh the stereotyping can go on forever!

 

I never made that assertion there Jumping Johhny, the only assertion I ever made about joining a landowner group is that I would never do it. I have my own personal reasons and frankly the only thing I have ever seen on here from the Group Organizers is first class "Side Show Carnival Barking", making me ever wary of the end result.

And guess what!!! Some people are currently finding out the hard way, that they indeed agreed to tie their land up for a year, then got excluded. My problem is there was never any mention of this in the Groupthink sales pitch. Only butterflies and rainbows...

My assertion was that any landowner who did not seek the advice of a qualified Iol and Gas Atty. is making a huge mistake. You can't read, and you also cant follow logic.

I assert this, very clearly. If this is post is even true, the person who started this post, went to an atty. with 10 acres and according to his story the Atty. took 5-6 months to fine tune the lease??? For 10 Acres??? What Atty. puts what language?? into a document?? For 5-6 Months for 10 acres??? This man or woman if real, was clearly misrepresented by that Atty. Fact.

I had the same experience with Shell and XTO (Exxon), although no problems with my attorney.  Had a lease from each company at $3500.00 per acre, both approved by my attorney, but when I was just ready to sign, both companies told me all leases were on hold.  They informed me about the drop in gas prices, and also that the companies were moving into Ohio due to fewer regulations than in PA.  They also said that as more infrastructure is built in Butler County, especially north of Rt. 422, and gas prices rise,  the companies would probably return to leasing in this area.

I recently learned that a neighbor about 3 miles from me just had their lease agreement fee paid to them after the lease was approved by Shell, but the money was received past the 90-day period.  They signed their lease in Jan. or Feb. 2012.

Some of us have joined a landowners' group that deals directly with the companies, and not  with subcontracted landsmen.  If you're interested, I can provide you with the information. 

Problems with Shell as well.  Signed back in Jan. only for them to pull out just days before the 90 day mark.  Given bs reason of surrender of lease filing from old lease I had.  In my case I have e-mails from Shell stating no need for surrender of lease as your old lease specifically says "expires on Dec. 31 2011". They recorded a surrender of lease and then say we are not resigning at this time.  Mean while I was signed since Jan.  Plus I am in Northern Butler County north of 422.  Just typical twisting of paper work to hold off from contract.  I could of had a surrender of my old lease at signing back in January and the land man had my old lease with the part highlighted as to when it expired and that it was no good at the time of signing so they were good to go.  Specifically told that was enough.   Basically they found a way to get out of contract until they are ready to sing in specific area again.  They said they will be back but at this point I don't trust anything they say.  Cj shoot me a pm if you would. Who uses the word ""Landsmen"" instead of.... ""landman""spelled in this manner all the time in an unflattering manner????

Did anyone from the BCLG receive their bonus check from shell yet?

My granddaughter bonus money cleared the bank yesterday....they have to have their hands

on it for a few days before they wil let it go....just under 90 days.

Remember, I signed a while after you.  When my 90 day draft was up a few months ago, they cancelled it.  I called and they told me it was due to the backlog of clearing leases in the Venango County Courthouse.  They issued me a second draft, this one for 60 days.  They have already pulled it back without an explanation and now I'm not getting return phone calls either. I'd be happy to just have them release me from the lease at this point. I plan to go to their office in Butler, PA next week and get someone to either pay up or declare the lease null and void.

Terry W  ...yes, you are correct, they are paying. Right now, in Butler county, they are only interested in, and leasing  in cherry twp. mercer twp. slippery rock, and Venango twp.

I was told by a Shell landman that they have "lost interest" in all but Mercer & Slippery Rock Townships.

Hmm, typical shell bs...  can't believe anything they say at this point.
