ALOV and Northern Trumbull County- Updated Discussion to include BP Lessor's and Bonus money Payment's

Hello all!

 I have been doing a little research and speaking with friends and neighbors about forming a group to address the needs of those of us not yet represented by a landowners group.

This led me to call ALOV after hearing that they had accepted some acreage in Trumbull county.

I paid little attention to ALOV earlier as their website did not list Trumbull county as an area of interest, although the work they were doing was certainly of great interest to me.

 From what i gather there was a cut-off of June 30 for sign-up with ALOV, they extended that and also had a meeting at RD banks Chevy in Champion. This may not be news to some of you, but i had not come across the posting until after. The word i got from an individual at ALOV was that Chesapeake set a northern geographical cut-off in Trumbull county of St.Rt.88, again this may not be a newsworthy flash to some. Many landowners attended, more than expected according again to a source at ALOV, and signed up their acreage.

Now heres the news, ALOV has agreed to start a "Waiting List" of still more interested parties from areas north of St.Rt.88. If you call them with name, address and phone number they will put you on the list, and depending on level of interest, they may choose to represent us as a group in a similiar fashion, with the same or even better terms to Chesapeake, or another interested party.

So call up ALOV, their number is listed on their site www.alov.us , and ask to be included in their next go around. From where i stand why re-invent the wheel, they already have done the groundwork and have the attention of the industry on favorable terms, lets ask them to either start another "Pool" to include us, or come work with us to the same end.

 Hello again to all my fellow Utica Shale Owners. I Just stopped in to ask if there were any who signed with BP from the ALOV Northern Trumbull county group, that resulted from these efforts, still around.

Has anyone had any conversations/correspondence from BP concerning title defects, or other issues that would delay payment or affect your lease, or gotten a check for Bonus money?

Rebecca, I hate to be the bearer of bad news but if the well is still producing your chances of having the lease invalidated are quite slim.  

We have a situation exactly like this and the owner works in a law firm, sadly they still are fighting it for a year now.

Have you been paid your royalty as promised?  Because if so then the owner working in a law firm has little to do with the merits of the case.

Ok guys.  Here's what it breaks down to.  December 1981 there was a well put on the property two doors down from us.  However, at that time, there was about 200 acres involving this property.  The property was split but the well is still associated with our property.  This was NOT disclosed to us at the signing of our home.  And, YES Kathleen....I'm taking my happy butt straight to my attorney tomorrow and this WILL BE CLEARED UP.  Or, at least we will understand what our rights are better and take some action.  It would be a sad shame if we just "let this go".  I know you don't know me...but I NEVER let anything go and always get things resolved.  Sometimes it's in my favor, sometimes not.  But, at least I'll know our rights and get this 30 year old lease lifted....honestly, I have spoke with other people today and I'm confident this will be an easy task.  Yes, it will cost us up front with attorney fees, but it should be quick. 

BP has given us 60 days to clear this title and they will then "consider" our lease as originally drawn:)

Thank you all for your comments.  I know all about teeth.  NOT LAND TITLES or gas/oil stuff.  Honestly, I don't care to and that's why my attorney is taking over:)  He has experience in this area and I'm excited to contact him tomorrow.

Its a 30 year old lease & we are sure we can get out of it. I have multiple papers from BP that are supportive of the situation. I talked to the title company yesterday & they "say" they r not respinsible...honestly....ILL LET MY ATTORNEY make that call. Guys the problem here is, yes its a working well, but NO we have never received a check in our name because we, as the land owners need to search this out ourselves. Thats black & white. However, my case is more like this: how do we excuse this 30 year lease? And who takes responsibility for not disclosing this info?.....in this screwed up world we live in right now, theres someone out there that knows what happened here & who dropped the ball. I have owned this land for 1 1/2 years & finding out a lot. Bottom line: Where There Is a Will, There Is a Way;)

Becki, I'd like to know how many acres you own. The way I understand it is...if your land was pooled with other parcels to build a drilling unit, there would have been a lease signed and some sort of payment made to whoever signed the lease as landowner...once that occurred, the lease is binding. 1980 was not that long ago and leases were usually well written, albeit, in the o&g's favor...GOOD LUCK!
Go to trumbull county recorder & u will get ALL info needed. Im learning every day. Issues with my property dating back to 1800s when this was over a couple hundred acres. Ill update everyone with useful info as i get it...for now, just gathering documentation. And yes, there were SEVERAL leases on this property never disclosed & we have title & insurance. Thats about the only RIGHT thing it seems we have done so far;))

Fang - that's a pretty obvious thought right there. Your right on both accounts. We are owed some money and we don't own the mineral rights. But this was just disclosed. However, I just found out THIS MORNING who does own the mineral rights...they are a couple in Kentucky that are deseased!!!! So, gets more interesting from here.
I talked to their family member just this morning and he assures me that he will work with us however we need him to. At this point, it's simply a signature to lift this lease.
@ "Knows-a-little"...your right about 1980 not being that long ago (actually I was a year old....haha)...but the transfer of the mineral rights was left out of the hands of the couple because they are dead now. So what then???? That's what I need to find out. This is my second property that I have owned in my time and never thought I would know this much about land. Still learning and sometimes the process is expensive. But, regardless, in the end, I want my land to be my land...We did have the title company do a search on the property before we signed and NOTHING came up. OOPS on their part.
It's all just beginning.

Well, the lease is not of interest to the son. I spoke with him this morning and he wants to sign over the mineral rights if he can. That's why there is a limbo here because we don't know how yet to go about this because it is in the deceased parents/families name. Still waiting to hear from my attorney this morning. (Put a call in at 9am). As far as the title company, I have the mortgage broker that we signed with getting me the specifics.

I would search the county where the couple passed to see if their will was probated and what it directed to do.  Then you will probably know who owns the rights. If they passed recently, the will may yet have to be probated.
