Letter: $150 million gone with the wind

T. Boone Pickens, who made his fortune in the oil business, finds wind “pickings slim” after admitting in an interview with Fox News Sunday, June 24, that he lost  $150 million on wind power, and is shifting his efforts on natural gas. He expressed frustration that politicians tend only to talk about energy independence when the price of gasoline is high.

Pickens has now canceled the bulk of a $1.5 billion wind turbine order that he placed with General Electric last year and says wind power will not be profitable until the cost of natural gas rises.

However due to the ability of companies like Chesapeake Energy, an Oklahoma City-based energy giant, to swap their leases or flip them  to another LLC, Ohio landowners who thought they signed up with Range Resources are not the only ones  in danger of shifty corporate swaps as this can easily open the door for foreign countries to control our oil and uranium property rights.

According to the Pittsburgh Post-Gazette (Erich Schwartzel and Elisabeth Ponsot), “Analysts on Wall Street and dairy farmers in this area now see the same thing: One powerful firm suddenly overtook the leases, and the rules of the game immediately changed.”

It’s not just the landowners who lose in contracts with these Big Money LLCs, be they wind or oil LLCs, national security and property as well as mineral rights can be acquired by any foreign country if the price is right. Chesapeake, like other companies, turned to foreign firms and multinational conglomerates to fund up-front costs of acquiring leases. Are we enslaving America to foreign interests for the love of money?

When China buys oil and gas contracts from Chesapeake Energy, will they automatically own the Uranium and the rights to harvest it? What legal recourse do landowners have to change the terms of their signed leases to include wording which will prevent the transfer or sale of the lease to China, Pakistan, Iran, North Africa, terrorists, etc. These were just a few of the serious questions that surfaced on GoMarcellusShale.com on June 24.

And finally one of my friends from Sheldon has long since thought that wind contracts were just an excuse for giant land grabs for gas and oil. Wind contracts included but were not limited to the right of the lessor to go “over, under, through and across the leased land.”

One more question, If an LLC’s (wind, oil, etc.) contract included the transfer of rights to all minerals and components occurring under the surface of the earth to the center of the earth, such as in the case of Chesapeake’s contract, keep in mind, the words, “including but not limited to” mean everything.

   O&G companies horse-trading leases is a reality that has been around forever. In the Utica, leases were signed by these companies in a heated rush, without necessarily concern about drilling units. Now that they are moving to the drilling phase, they need to have contiguous leased acreage. Hence they engage in horse-trading with each other to attain sensible drilling units (at least in their estimation).

    The good news for lessors is that drilling will occur sooner rather than later, and the new lessee is obligated to meet all terms of the original horse-traded lease. So, if the lessor has a "good" lease, it remains a "good" lease. The opposite also applies. If the new lessee wants to change terms of the lease, he must re-negotiate with the individual lessor. 

    It's a shame that the land men occasionally resort to "scare tactics" during the process. As far as foreign companies owning the leases, the O&G business became global years ago. Really, we (Americans) are the largest "culprits", if one wants to depict it as such, of a "foreign" country extracting O&G resources from other countries.

  It's a worthy discussion topic, which of course is what GMS is all about. But it doesn't mean we can't have fun with it, too! I heard the Muslim terrorist babies were bred to infiltrate the O&G companies!

Craig we can always just sit back and when it happens scratch our heads and say WHAT HAPPEN !

Well what the heck , it's better to have your head in the sand and not get sun burned .

Time, It is an honest topic, but it has been hashed about so much, that I just can't take the subject anymore. I don't waste a lot of my time on the subject. I've read some of the Utica JV paperwork and from what I gleaned about the only thing they can do is specifically written in the contract which doesn't include 90% of what was posted. In the future there maybe a  JV that will work differently, so it is best to keep your ear to the ground, but there is no need to start pounding on the ground. 

BLue flame hit the nail on the head as well as this fact:

If us Americans weren't bent on buying only the cheapest priced products the Chinese wouldn't have most of our money to spend on such things as a JV here.

Unfortunately for us, or fortunately, depending upon your viewpoint the Chinese have been buying up a lot of our debt for quite awhile now.

They don't need to do anything else to upset our country except to quit buying our debt and off load the current debt of ours that they hold. Do you really think they want to destroy the US economy and then lose their biggest customer for their goods?

On the negativity thing that can be taken in different ways ,sounds like 

to me that doesn't apply to you you .

After a while people saying that  don't worry :IT COULD NEVER HAPPEN  HERE  :

My point  is don't take negativity for an excuse not to stand up for whats 

right , as I said that doesn't seem to be the case with you .

I don't think China will have to colapes our economy , they will just own it with 

out a shoot being fired .

I remember your earlier comment on my post on China and there buying 

our leases and setting up camp and  calling me a LUNATIC . If I'm
