HB 537 - An Intrusive & Obstructionist Bill Being Discussed In The Agriculture & Natural Resources Committee

Who defines what an 'Urbanized Area' and / or anything else the Ohio Division of Natural Resources concerns itself with is; in the context of proximity to new Gas & Oil wells  ?

Is this determination made solely by the Ohio Division of Natural Resources ?

Or is it determined by the ODNR after consulting with local governmental entities (like a Council / Grange / Board of Trustees / etc.) ?

Can the ODNR determination be over-ridden by a local governmental entity (should the local governmental entity consider the proposed well site as falling within a 'Rural Area') ?

Is this Pro-Active or is it Obstructionist ?

Please discuss.

According to Agenda 21, they will pay you - but never, ever what it is worth.   We get something good in this country that can keep our area somewhat prosperous and the scumbags want to take it away.    They want everyone to be poor and under their control.

Maybe this is just the State of Ohio Legislature's Standard Operating Procedure but I see that there is also a SB 378 (Senate Bill) generated Sponsored by Senator Schiavoni and Co-Sponsored by Senator Cafaro that deals with well setbacks and of course the Bills are in conflict as they pertain to paragraph 1509.021.

This SB 378 was introduced on 10/04/12 and assigned to a 'Agriculture, Environment & Natural Resources Committee.

This SB 378 has alot less to say and what it does say makes more sense to me.

This Bill allows Landowners to waive (in writing) the proximity of wells to dwellings.

I've saved the Bill to a pdf and also uploaded it to this discussion.

So what does everybody make of this situation as I don't know what to make of it ?

Looking into the old crystal ball and I'll tell you what I see:

HB 537 (Horribly Bad Bill)

SB 378 (Bad Bill but not as Bad as HB 537)

HB 537 gets sent back to the House by the Senate.

SB 378 gets sent back to the Senate by the House.

Both Senate and House site Partisanship.

A new Committee forms and comes up with a combination Bad Bill which would probably get passed by both House and Senate and the Governor then signs into law.

Drilling and the Economic Recovery STOPS - as the Drillers / Developers get out of Dodge.

A Lose - Lose situation.

Lose time and the Economic Recovery.

How STUPID would that be ?

Hoping my crystal ball is out of calibration and cannot be relied upon.
