I don't know why people are starting to feel guilty as to settle or support a lesser severance tax.  Did the State of Ohio purchase your farm for you? Are they paying your mortgage on your behalf?  Does the State own shares of stock in your farm? The severance tax is really the State cutting out an overriding royalty for itself, all while not even to have made any investment in your land themselves.  They won't be the last to come picking.  They have their state parks, office parks, jails, universities, and additional lands they have managed to eminent domain, so let them get their cash from that.

Pray a mis-step such as was dome by Kissinger with Russia when he said that HE had authoritative power of control vs. saying, WELL I'l need to get to my boss (US Pres.) & get back to you on this. THAT would have given maneuvering room for US - instead we were put into a position of 'right here, right now...you SAY you have 'the authority' to MAKE DECiSIONS Mr. Kissinger...whoa.

Maybe THAT is ultimately why Nixon got nixed (Nixon nixed...ha,ha...).

ANYWAY - inchworm antenna, good point. WHY do people 'feel guilty'? It's x2 fold.

1) We are a Judo-Christian ethic that 'ingratiates' our mindset to being 'kind'. & THAT in & of itself IS 'fine', but 'kill them with kindness' only goes so far. When you've got a lunatic on your doorstep demanding God knows what...GOD want you to defend yourself. He is a God of love as WELL as a God of punishment & hate at times...KNOW His word.

2) We have been dumbed DOWN to be lap-dog trained & brainwashed to be TOO 'politically correct' (POLITICAL CRAP)! ***No one takes your power from you - YOU 'give it away'. We've kind of been 'European-ized' - turned into lap-dog IDIOTS!

THINK HARD about that. WHAT are you? There's nothing to wrong with the concept /mindset of ***AGREEING TO DISAGREE***.

THINK! As one light lights another, nor grows less - so nobleness enkindles nobleness.

BE YOUR OWN PERSON. STAND FIRM. GOD respects THAT. PEOPLE should NOT 'feel guilty' or that they 'owe anyone' anything. I'm not in ANY way saying not to 'help your neighbor as yourself' when in NEED. SINCERELY, but when push comes to shove...you really don't go farther than that - do you?...good neighbors are 'no neighbors' kind of thought. MAYBE were SO 'smack up against one another that we don't OBSERVE & THINK for ourselves the way things were once done?

I'm not sure how this increase is exactly worded, but in the rest of the country the severence tax is paid by the Oil & Gas company.  Even where leases are decades old, the producer pays the tax, not the landowner.

  I just re-read my lease, and buried deep in the rhetoric is a clause which says "despite anything to the contrary, Lessee shall be responsible for all severance taxes associated with production of oil & gas under this lease". Furthermore, oil & gas is defined to include NGL's and condensate. You are correct (at least for my lease).

Oil companies wouldn't fight so hard against these taxes if they were just going to make the landowner pay them.

 

I still don't think severance taxes are a good idea though, they discourage investment and kill jobs.

  I lived in Texas for several years, where there is no state income tax, but a reasonable severance tax. Companies moved to Texas in droves during my years there, at least partially to avoid state taxes. Midwesterners abandoned the "Rust Belt" for good-paying jobs and great opportunities in Texas.

  Therefore, properly formulated as revenue-neutral and offsetting the state income tax dollar-for-dollar, I could support a modest increase to the severance tax. That's a big "if", and the politicians are unlikely to create such a tightly written, narrowly formulated document. As noted earlier by others, the temptation to "enhance" the document with other special interest issues is just too great for politicians to resist!

NO -  mineral income should not be taxed more than once.  If they are going to tax the severance then there should be no income taxes or property taxes on the asset!
