I posted a message, I thought, about anyone else out there that has mineral rights located on the K&R

Conservation property, in Londonderry Twp., Guernsey County, OH. I do not see my posting on the Marcellus

site and have not received any replies. Not sure if I clicked at the wrong place to post it.

I will post this again and will not do it again, if I don't hear back from anyone.

I was just curious if I was the only mineral rights owner, whose rights are located on the vast amount of

acreage K&R owns. I CANNOT believe that that can be true. The map from the Recorder's office shows many  mineral rights owners, I am just curious if anyone, somebody still own their

mineral rights on the K&R's property and have questions about K&R not allowing drilling because K&R does not

own all the  mineral rights on their property, as they thought they did? There is drilling all around the K&R

acreage but not one bit of drilling on this property, where my mineral rights are.

If there is another mineral rights owner, out there

somewhere, whose lease is on the K&R Conservation property,

will you please contact me on this Marcellus site. Would like to know if you have any info from AEU or if you

have taken any legal action, individually or as a group. I would like to be part of this, if so.

I feel for ya, man. But There's not much I can help you with. Cant imagine why there would be a secret involved. No one is talking about it. I'm sure someone has answers. The Londonderry area is being drilled with good results. Good oil!  That big chunk of land ought to be desirable, but don't know what the legal problems could be that couldn't have been solved by now. People in that area don't seem to be on this site,if they are, they don't taslk. Maybe , since it's so Rural, they don't have computers yet?

I live out of state and cannot access anyone in that area, that might have mineral rights, also, on the K&R property or find any info, from them,  about what is going on with this lull in the lack of drilling, on the K&R property. As I am sure you have already gathered, I only own the mineral rights. My Dad sold the property in the 60's.

Glad but sad to hear that there is drilling for oil in that area of Londonderry Twp., Guernsey County. I think  like you, when you state that-- what could be so legally involved that it could not be "fixed" by now(K&R Conservation & AEU) and drilling to proceed?

I have never been contacted to sell my right to K&R or AEU. Well, that's not entirely true. I received a letter from AEU, back in Dec.'14, wanting to buy my rights but after me responding back to them, to see what they might be willing to pay me, they never got back with me.

When I went to the recorder's office, to register my lease, with Shell in 2011, at that time, then AEU, I was told the area my rights were on, was a hot spot. Now, almost 4 years later there has not been any activity whatsoever or no info as to why no drilling, except a Lyndsey Fixley, from AEU, who responded to my inquiry of why no drilling, responded with a one liner---------------this is a legal matter and we don't even know if we will renew your lease in 2016.

I am in a state of shock that my rights, that are located in a o/g rich area, will never be utilized! I can't even see where anyone would want to buy my mineral rights at this point of time. I have thought about going that direction, too.

I don't even know where to turn. I can't see where a lawyer getting involved would help. Now that my future royalties look bleak, I must watch where my $$ goes.

But I do know I thank you and the other faithful, knowledgeable people on this site, that share their insight with me and the other readers. Most appreciated. I am not to savvy about this o/g business "stuff"! Have learned a lot about the industry, on this site, though.

Do you or anyone else have any ideas what I should or could do to be more informed about this supposed legal problem with K&R and AEU, that is holding back any royalties I might be able to have cashed in on?

If I were you I would come to Ohio and spend a week or two and do some research. Look up other possible mineral rights owners in that area that you speak of. You can find all this info at recorders office. Call them , visit with them and see what they have to say. All this info is just sitting their and you just need to go investigate a little to find out what may be going on. Just my thoughts but it seems well worth the efforts.

Sad to say, I have 2 brothers in Ohio, real close to Freeport, but they don't seem to care. I will do the leg work and they will reap my time, $$ and discovery, if any.That is how it has always been!

No family togetherness in my family. I had to get the attorney located in Ohio, suggested on this site, from here in NC and my brothers did not even return several e-mails I sent to them asking questions.

I am on my own, in many ways!

I am not sure if I understand totally, is there any drilling on the property in question ? If there is not drilling just on the K&R but all around it  the answer is probably pretty simple.

With abundant drilling opportunities the oil and gas companies will probably just go around the property in question and forgo the legal wrangling that either is occurring or will occur in regards to the mineral rights.

I feel for you, I would help you if I could but I am in Millwood township and not familiar with anyone up in Londonerry township.

Thanks! No, there is no drilling at all on the hundreds of acres where my mineral rights are located.

You are probably right about just going around the property and avoiding the legal part of this.

I just don't know why the K&R Conservation would not want to cash in on the $$ they could make by just being paid for the right to drill on the property.

Something else that is odd. I have been informed that the trees have been cut down and a pad built on this property. 

Was told,by a rep at AEU, when I e-mailed him to question why no drilling, he replied and said this lack of activity, on K&R's property, is a result of a Dormant Mineral Act issue(DMA).

Where does that leave me and anyone else whose mineral rights are located there? My lease runs out in 2016.  In the same e-mail from AEU rep,he mentioned there is a good chance AEU will not sign with me, again.

It doesn't make sense to me that AEU, who paid Shell for my lease, would just let this die.

I can't be the only one they paid a pretty penny to, that has mineral rights on this property, K&R owns.

From what I have read on this site, Aubrey McClendon (AEU) is not the kind of man who  just  would give up his rights to drill and lose the $$ he paid Shell, for the leases on this property.

Evan, I agree,a trip to Ohio is one way of hopefully finding something out.

Some heath problems with my wife so am not sure when.

Often times it appears matters are at a stand still only to suddenly have matters move in a direction maybe not anticipated and at a rate not thought possible.

The pad construction is a plus, that may mean something is going to happen, maybe looking at the ODNR map will show some new permits in relation to the pad, although I am told the map is slow to be updated.

I cannot tell you how much it beffudle's me to see how some people have reacted to the whole shale thing, I cant explain why they would be against the drilling.

The DMA is a good idea in thought but I am afraid it was poorly written and has made many a lawyer's yacht payment as a result.

I hope and believe your situation will be resolved. I wouldn't worry a ton about what AEP told you concerning your lease being re-upped, there is a ton of miss direction in the business.

Sorry to say, but no oil co. no-adays wants a lease like we signed with Shell, back in2011/12. Gross,and No deductions for anything, are 2 things none of them want in a lease. AEU will probably want to have those expire before they would re-up the same terms. IMHO.I'm in the same boat,in Guernsey co. and am prepared to deal with the same thing here in a year,or so.If everyone who signed those leases just said no, they may change their mind, but plenty of folks,worrying about getting left out, I figure,will go along with the new offers. Time will tell. I'll be researching that pad that was supposedly built. maybe I can save you a trip. But that trip, may be a good idea anyway,if you can swing it.

N.C. man, did your source say just where this pad is located? Your land,or close by.? K&R have sooo much acreage,it could be hard to find without some direction,or address.  thx

Bo, I can tell you the main entrance (as far as I know the only entrance) to that property is off of Skullfork Rd, just northwest SR 22; and it's gated. Not much can be seen from the road, with the exception of the lack of vegetation that once used to cover the hillsides. I have not ventured up Mine Rd ? (I thought it was something else, but that's what's on Mapquest) to see if anything can be viewed from there yet. Maybe I'll run up there to give a look, and post if so.

WOW!! You are exactly at the right location! My Dad's property was approximately 1/2-1 mile due west of the gate entrance.

I don't remember who stated, on this site,that the trees were lumbered out and supposedly a pad put down.

Wouldn't you think if someone(AEU?) went that far to take trees out and lay pad, there was a good intention to doing something and permission was granted from K&R to do all of that to K&R's property?

That is what is perplexing to me!

I looked on ODNR map last night and it looks like there are some vertical gas wells in  section (21), township 11, range 7,  near where my mineral rights are located. Would that effect anything, as far as fracking goes?

1989 dormant mineral rights being decided by Ohio supreme court. If you did not file a preservation to maintain your mineral rights they may have reverted to the landowner. I live in tn own property in Richland township. We signed with shell in October 2011 with two parcels we found out there was a company that claimed our mineral rights back to 1940 my family purchase in 1946. They have leased our rights on 25 acres to antero. I am waiting for Supreme Court to decide if they did not file a preservation since 1972 the 1989 dormant mineral rights will return our rights to my family who own the property. We will file a law suit at that time. Shell paid us for one tract but did not pay for the 25 acres. Ck case 2014 0804 Ohio Supreme Court oral argument 5/6/2015. I think company's are holding to insure they are leased with owner of the mineral rights. Dormant mineral act of 1989 required preservation form be filed every 20 years to maintain.
